Rule Chapter 570, Rule Chapter 570, Uniform Reporting System for Uniform Reporting System for Prescription Drug Price Data Sets Prescription Drug Price Data Sets MHDO Board provisionally adopted proposed changes in October 2020 (major substantive rule); then submitted to Legislature. One of the issues discussed and agreed to in the HCIFS committee work session was to adjust the level of reporting in our proposed changes for the Pharmacy Benefits Manager (PBM) reporting specifications from the US level to the State level Legislature and Governor passed LD 41 (proposed changes in Rule Chapter 570) in June 2021 Unfortunately, the revision noted above did not get into the final version of what was passed The effective date for nonemergency laws passed in the first special session of the 130th Legislature is October 18, 2021 2 MHDO BOARD MEETING SEPTEMBER 23, 2021

Rule Chapter 570, Rule Chapter 570, Uniform Reporting System Uniform Reporting System for Prescription Drug Price Data Sets for Prescription Drug Price Data Sets LD 686, An Act to Increase Prescription Drug Price Transparency also passed this session, Public Law 2021, Chapter 305, and will become effective October 18, 2021 There are now several provisions in Rule Chapter 570 that are inconsistent with the new law. When this happens, the statute overrides inconsistencies in rule Staff is preparing language to be included in the board's final adoption of Rule Chapter 570, that will address the inconsistencies with the new law Staff will present a new policy for the board s consideration to address the rule issue regarding the level of reporting for PBM s (US vs State) 3 MHDO BOARD MEETING SEPTEMBER 23, 2021

MHDOs Health Information Advisory Committee MHDO s Health Information Advisory Committee LD 541, An Act to Improve Health Care Data Analysis, now Public Law 2021, Chapter 423, created the MHDO Health Information Advisory Committee. The advisory committee is established to make recommendations to the organization regarding public reporting of health care trends developed from data reported to the organization. Duties of the Advisory Committee as Duties of the Advisory Committee as defined in defined in 8718 8718 The advisory committee shall make: Recommendations to the organization to establish priorities for health care trend data items; Recommendations to the organization on the annual public reporting of health care trend data items; and Additional health care data trend-related recommendations as requested by the executive director of the organization. 5 MHDO BOARD MEETING SEPTEMBER 23, 2021

The executive director of the organization; B. One member of the Senate, appointed by the President of the Senate; C. One member of the House of Representatives, appointed by the Speaker of the House of Representatives; D. The commissioner or the commissioner's designee; E. The Superintendent of Insurance or the superintendent's designee; and F. Six members appointed by the board as follows: (1) One member representing consumers of health care; (2) One member representing providers; (3) One member representing hospitals; (4) One member representing employers; (5) One member representing carriers; and (6) One member representing the state employee health plan under Title 5, section 285. 6 MHDO BOARD MEETING SEPTEMBER 23, 2021
