Division of State Lands Overview Overview The State holds title to Sovereign Lands in trust for the people of Nevada in order that they may enjoy the navigation on the waters, carry on commerce over them, and have the liberty to fish and enjoy other recreational activities Per NRS 322.100 1 (b) NDSL must charge a fee in an amount as the State Land Registrar determines to be reasonable based on the fair market value for the use or occupancy of public lands Senate Bill No. 512, Chapter 366, 79THSESSION 2017, Requires the State Land Registrar to establish certain fees by regulation for the use of state lands; revising provisions relating to the accounting and use of the proceeds of certain fees for the use of state lands
Division of State Lands Research process after the passing of SB 512 State Lands researched minutes and other documentation related to navigable water fees and the use of State Lands from Regulation meetings of the 59th Session of the Nevada Legislature, Chapter 529, Statutes of Nevada 1977, and by the Attorney General s Opinion 204, dated April 20, 1976 We tested the in-house cost method used by NDSL to determine fees for the use of State Lands and applied it to several examples of site plans authorized by State Lands to validate the proposed fees; this method is similar to methods used by other western states for their navigable water fees
Division of State Lands Research process after the passing of SB 512 (cont) We reviewed current rates and evaluation methods used for other western states including their in house cost methods We reviewed the rental rates for buoys and boat slips at marinas and other waterfront commercial businesses; our research included Lake Tahoe, Lake Mead, Lake Havasu, the Colorado River as well as other western states We secured a formal appraisal from an independent appraiser licensed in the State of NV
Division of State Lands Research process after the passing of SB 512: Review of current fee structure Per statute (1993), NDSL collects $30 annually for private buoys and $50 annually for private piers Per statute (1993), NDSL collects $100 annually for commercial buoys and $125 annually for commercial piers Navigable water fees collected total approximately $65,000 on an annual basis; these fees are deposited to the State s general fund
Division of State Lands Proposed Fee Schedule Analysis Fees have not been updated for 25 years and do not represent current market value The in house cost method used for all NDSL authorizations for State Land supports the proposed fee schedule The independent appraisal reveals the analysis used to develop the fee schedule was conservative
Division of State Lands Environmental Improvement Program Fees collected that exceed $65,000 will be used for environmental improvement projects at Lake Tahoe (i.e. water quality, AIS) NDSL has been the lead agency in implementing the Lake Tahoe Environmental Improvement Program (EIP) for the State since 1998 To date, 127 environmental improvement projects in the areas of water quality, forest health, recreation and wildlife habitat have been implemented through our programs On an annual basis, NDSL evaluates and updates a 5-year priority project list for the EIP
Division of State Lands Proposed Fee Schedule BUOY COMMERCIAL BUOY PRIVATE PIER COMMERCIAL PIER PRIVATE The proposed fees will be predictable from year to year (no complicated calculations) and will not be re-evaluated for a minimum of 5 years The proposed fee increase will implemented over a 3 year period $2,000.00 $1,000.00 $500.00 $300.00
Division of State Lands Outreach Sent mass mailing to all current and prior permittees Notifications posted in all public libraries in the State Website notifications posted on State, LCB and the NDSL websites Held 4 workshops in Incline Village, Zephyr Cove and in Laughlin Nevada Held meetings and conference calls with representatives of multiple stakeholder groups Public notice printed in local Lake Tahoe newspapers
