Late Liquidation for EANS-I August 2023 1
Terminology First, let s get some clarity around terminology: Obligation A formal commitment to spend funds, but this can vary depending on the kind of commitment. Performance Service delivery and receipt of equipment and/or supplies. Liquidation Submit receipts/invoices through ClassWallet. Late-Liquidation Flexibility, receipts/invoices after the primary liquidation deadline due to pandemic-related challenges. if approved, to submit 2 2 2
Important EANS-I Deadlines When the US Congress appropriates money for a grant program, it usually contains an obligation deadline. CRRSA EANS-I Obligation Deadline: 9/30/2023 Performance can happen (services can be delivered) for a short period of time (60 days) after the obligation deadline. CRRSA EANS-I Service Delivery Deadline: 11/29/2023 Funds can be liquidated/claimed (receipts/invoices submitted through ClassWallet) for 30 days after the service delivery deadline. Timeline Period of Availability for Federal Grant (Generally 27 months) 1. Obligation Must Occur (34 CFR 76.707) +60 days 2. Performance of Validly Obligated Contract (Certain Contracts Only, see Obligation Chart) +90 days 3. District Liquidation/Drawdown of Grant Expenditures and Closeout of Grant 4. DESE Liquidation of Federal Grant +120 days January 28, Year 3 December 29, Year 3 November 29, Year 3 September 30, Year 3 July1, Year 1 4 4 4
EANS-I Obligation Deadline Remains 9/30/2023 The US Department of Ed (USED) has no authority to extend an obligation date, unless they are explicitly granted waiver authority by Congress. We have seen no indication that Congress will consider granting such waiver authority to USED. Therefore: Reimbursements: All invoices ClassWallet must be dated between Friday, March 13, 2020 and Saturday, September 30, 2023; and Services and Assistance: All invoices by an approved EANS vendor that will be submitted for possible direct payment must be ordered/requested from the vendor between Friday, March 13, 2020 and Saturday, September 30, 2023. or receipts submitted to 5 5 5
EANS-I Liquidation Deadline limited flexibility All requests for reimbursement and requests for direct payment of invoices from an approved EANS vendor must be submitted in ClassWallet on or before Friday, December 29, 2023, to be considered for payment using EANS-I funding, unless the non- public school is approved for late liquidation flexibility of specific purchases. EANS-I Late Liquidation Fortunately, unlike with obligation deadlines, USED does not need authority from Congress to waive/extend liquidation deadlines, which would also effectively extend the performance period. 7 7 7

Applying for EANS-I Late Liquidation The federal government announced up to an additional 14 months to liquidate funds, but only in select cases on an expense-by-expense basis. It is NOT a blanket provision that can be used for all situations. Schools must: Obligate EANS-I funds by 9/30/2023; Provide evidence (upload docs) that funds were obligated on time; Provide a compelling rationale for why late liquidation is needed, beyond simply needing additional time, how much time is needed, and why; and Provide assurance that the school has the capacity to liquidate funds within the extended period. Schools can submit late liquidation requests now through September 30, 2023. 9 9 9
Approval or Denial - Caveats Both DESE and USED must approve requests DESE receives your requests, and if deemed approvable, must submit to USED for final approval DESE will review requests on a rolling basis, and will contact you ASAP with a determination Please note that submission of a request does not guarantee approval for a liquidation extension. Therefore, schools should plan for an alternative source of funds for any contractual performance extending beyond the standard performance period (November 29, 2023) should an extension request be denied. Further, if a late liquidation request is approved by DESE and USED, no changes can be made to the specific project or contract. If the executed contract cannot be fulfilled, the funds subject to late liquidation must be forfeited. 10 10 10

One More Note EANS I vs. EANS II Late liquidation is only available for EANS-I (obligation deadline of 9/30/2023). USED has not (yet) said anything about late liquidation for EANS- II, which has an obligation deadline of 9/30/2024. 13 13 13
