Aims To provide an overview of the structure and content of the new All Wales Safeguarding Procedures To provide an insight into how the new procedures require a new approach to safeguarding To highlight the specific shifts in practice in relation to each section of the procedures in Adults and Children

Important points to note shift in culture and practice Children Section 1 The procedures bring about a significant shift in culture and practice Procedures are a live document and will be continually updated (running alongside Regional Safeguarding Board procedures) Procedures are in paper form Procedures are underpinned by the child centred and preventative principles and duties of the Social Services and Wellbeing Act 2014 (SSWBA) Procedures are underpinned by a focus on paperwork and compliance with policies and procedures Working co-productively with the family Culture of doing to the family Child at risk Child at risk definition (broader categories) www.gofalcymdeithasol.cymru www.socialcare.wales

Important points to note shift in culture and practice Children Section 2 The procedures bring about a significant shift in culture and practice Referral to Social Services about concerns Report to Social Services about concerns The Child at Risk is central to all decision making with a strong focus on improving their daily lived experience Focus on the risk and not the child Consent is actively sought from the parent and the child / young person (where appropriate) Reluctance to obtain consent from the parent Social Services responsibility once a referral is made to them Ongoing responsibilities of the person making the report www.gofalcymdeithasol.cymru www.socialcare.wales

Important points to note shift in culture and practice Children Section 3 (Part 1) The procedures bring about a significant shift in culture and practice Focus on making the child safe, shaping responses in line with wishes of the child at risk, ensuring proportionate actions are taken to protect and support the child at risk Strong focus on the professional view of the child s risks and welfare Six possible outcomes of the strategy discussion Four possible outcomes of the strategy discussion or meeting Section 47 investigations that are focused on the parents view of the family circumstances Section 47 investigations that gain an insight into the child s daily lived experiences Section 47 enquiries running alongside initial and/or core assessment Section 47 enquiries running alongside a care and support assessment www.gofalcymdeithasol.cymru www.socialcare.wales

Important points to note shift in culture and practice Children Section 3 (Part 2) The procedures bring about a significant shift in culture and practice One of two decisions to be made at conference: 1. Child not at continuing risk of harm but may have needs for care and support 2. The child s name (if experiencing or at risk of harm) is placed on the register and child made subject of a care and support protection plan The only decision that can be made at the conference is whether or not the child s name is included on the child protection register, and, if so, under which category The determination of appropriateness of registration is informed by a balance of managing risk, meeting needs and achieving the child s outcome The determination of the appropriateness of registration is predominantly focused on the level of risk Named key worker Care and support protection plan co-ordinator www.gofalcymdeithasol.cymru www.socialcare.wales

Important points to note shift in culture and practice Children Section 4 The procedures bring about a significant shift in culture and practice Child protection plan Care and support protection plan Any practitioner member of the core group can chair the core group Core groups tend to be chaired by the Social Worker Children and young people are entitled to an active offer of advocacy from a statutory Independent Professional Advocate (IPA) The child s voice and experience often overlooked Written agreements Care and support protection plan Child protection planning and review focuses on services being provided and compliance of the parents Care and support protection planning and review underpinned by the principles of the SSWBA www.gofalcymdeithasol.cymru www.socialcare.wales

Important points to note shift in culture and practice Adults Section 2 The procedures bring about a significant shift in culture and practice The best interests of the adult at risk must be the overriding consideration when deciding whether to seek consent prior to making a report Consider if a vulnerable adult is capable of giving consent and, if so, their consent must be sought Presumption of capacity implicit throughout procedures An individual s capacity is in doubt The adult at risk is central to all decision making. Using Risk Assessments to support people to have as much freedom and control as possible. Focus on restricting people s choices. Focus on the risk and not the person. Move from a focus of proving / disproving abuse / neglect. Focus on promoting protection planning and early intervention / prevention www.gofalcymdeithasol.cymru www.socialcare.wales

Important points to note shift in culture and practice Adults Section 3 The procedures bring about a significant shift in culture and practice Focus on making the person safe, shaping responses in line with wishes of the adult at risk , ensuring necessary actions are taken to protect and support the adult at risk Strong focus on Local Authority having an investigatory role Local Authority has statutory duty to make enquiries (s.126) and 7 days to undertake these enquiries Initial evaluation to decide if the Adult Protection Procedures apply Local Authority may delegate responsibilities for enquiries to be undertaken Local Authority conducts initial evaluation Strategic Lead/Senior Co-ordinator officer AND Adult Protection Co-ordinator Lead Practitioner AND Lead Co-ordinator www.gofalcymdeithasol.cymru www.socialcare.wales

  18. What do I say if someone tells me about a concern about a practitioner? As with any allegation of abuse, neglect or harm you receive: DO DO NOT Listen and take them seriously Keep an open mind Accept what they are telling you Handle the allegations / concerns in a fair, consistent and timely manner Follow statutory guidance and explain to the person what you have to do next Investigate or ask leading questions Make assumptions, interpretations or alternative explanations Promise confidentiality to them

  19. Professional strategy outcomemeeting Decide whether, on the balance of probabilities, the concerns are substantiated. Substantiated Unfounded the person making the allegation misinterpreted the incident, was mistaken about what they saw, or was not aware of all the circumstances there is sufficient evidence to prove the allegation Deliberately invented or malicious clear evidence to prove the allegation is entirely false and there has been a deliberate act to deceive Unsubstantiated there is insufficient evidence to prove or disprove the allegation

Summary Person / Child centred approach The Child / Adult at Risk is central to all decision making Co-productive approach with children and families / adult at risk Presumption of capacity implicit throughout procedures Duty to report a child / adult at risk Multi-agency approach to identifying and supporting adults / children at risk Proportionate approaches to safeguard the child / adult at risk.
