  2. The 2020 Landlord Contracts will be available next month. The contract is contained on-line. Remember that if there are multiple people in your organization, only the Primary contact can access the contract. If you aren t sure who that is, contact the Off-Campus Housing Office. This is best done by sending an email with your organization or property along with who the primary contact is to och@byu.edu.

Landlord agrees to prohibit the on-site possession or storage of any firearm, explosives, fireworks, or dangerous weapons, including knives (except reasonable cutlery) or other items which, in their intended use, are capable of inflicting serious personal injury. One of the contacts must reside or do business within the immediate area of Provo, Utah, and have a residential address at which students may deliver or post notices and communications.

  28. 13. Landlord understands that the manager, whether the owner or an agent of the owner, is not an agent of the university. Accordingly, the owner agrees to indemnify and hold harmless the university against any loss or expense including reasonable attorney's fees arising out of any acts or omissions of the manager. The owner is solely responsible for the actions (monetary or tangible) of their agents.

Landlord agrees to notify BYUs Off-Campus Housing Office of a change of ownership, i.e., any change in the named owner of the rental facility, or any substantial change (transfer of more than 50% interest) in the entity identified as the owner. New owners must apply for a housing contract with the BYU Off-Campus Housing Office and proceed through the contracting process within 30 days of closing. New owners must also honor any existing rental contracts.

New owners must apply for a housing contract with the BYU Off-Campus Housing Office and proceed through the contracting process within 30 days of closing. New owners must also honor any existing rental contracts. There is no guarantee that a property that is currently contracted will be granted a contract. If you sell, please let the new owner know they have to contact our office. If the ownership changes names, we need to know.

  34. 17. Landlord agrees to allow representatives of the university, government agencies and all other public safety inspectors to inspect all units of the facilities at reasonable times to determine compliance with this agreement or applicable law.

Either you or your tenants may request an inspection by someone in our office. We also may do random inspections on units. During the summer we do exterior inspections on all properties.

Landlord agrees to maintain the facilities in accordance with all applicable federal, state, county, and city laws or ordinances and with the applicable Minimum Specifications for BYU Contracted Off-Campus Housing shown in Section 20 of the Handbook. Landlord agrees to comply with any reasonable requests of the BYU Off- Campus Housing Office relating to the safety or general welfare of tenants, and correct any failures to comply with such laws, ordinances, and specifications in a reasonable time.

Landlord agrees to maintain the facilities in accordance with all applicable federal, state, county, and city laws or ordinances and with the applicable Minimum Specifications for BYU Contracted Off-Campus Housing shown in Section 20 of the Handbook. Landlord agrees to comply with any reasonable requests of the BYU Off- Campus Housing Office relating to the safety or general welfare of tenants, and correct any failures to comply with such laws, ordinances, and specifications in a reasonable time.   38. 19. Landlord agrees to be compliant with all zoning and occupancy for its particular unit. If the unit is found to be over-occupied, thereby requiring one or more of the tenants to move, the deposit and prepaid rents must be returned to the terminating student on the date occupancy is terminated. If extensive interior remodeling is planned, prior written notice must be given to the BYU Off-Campus Housing Office for approval.

Landlord agrees to make a good-faith effort to settle any controversies with BYU student-tenants in accordance with the Dispute Resolution Procedures of the BYU Off- Campus Housing Office as outlined in Section 21 of the Handbook. Landlord agrees to abide by the rules and decision of the arbitrators of the BYU Center for Conflict Resolution when a controversy is presented to them. Landlord agrees to refrain from unjustly evicting the tenant or harassing or retaliating against him/her for exercising their rights under the contract or Utah law.

Landlord agrees to make a good-faith effort to settle any controversies with BYU student-tenants in accordance with the Dispute Resolution Procedures of the BYU Off- Campus Housing Office as outlined in Section 21 of the Handbook. Landlord agrees to abide by the rules and decision of the arbitrators of the BYU Center for Conflict Resolution when a controversy is presented to them. Landlord agrees to refrain from unjustly evicting the tenant or harassing or retaliating against him/her for exercising their rights under the contract or Utah law.   42. 21. In exchange for these agreements, BYU designates Landlord as a provider of BYU- contracted housing for single students. The parties agree that the terms of this contract are material, and that violation of any of them by Landlord or its agent(s) may constitute sufficient cause for immediate revocation of the contract of the facility. In the event of such contract cancellation or in the event of failure to timely secure a contract, Landlord agrees that any student may elect to terminate the rental agreement with Landlord upon five days' written notice to Landlord.

  43. 21. In exchange for these agreements, BYU designates Landlord as a provider of BYU- contracted housing for single students. The parties agree that the terms of this contract are material, and that violation of any of them by Landlord or its agent(s) may constitute sufficient cause for immediate revocation of the contract of the facility. In the event of such contract cancellation or in the event of failure to timely secure a contract, Landlord agrees that any student may elect to terminate the rental agreement with Landlord upon five days' written notice to Landlord. Contracted housing not approved. You as a landlord have signed a contract with BYU to be a provider of single student housing.

  44. 22. Student tenants are explicit third-party beneficiaries of this contract and these provisions apply regardless of the terms of their rental agreement. Landlord agrees to remit within five days the balance of any prepaid rental or deposit monies or both to any student electing to terminate tenancy after BYU Off-Campus Housing Office notification that the contract of the unit has been withdrawn or if the owner fails to finalize the contract by the commencement date of the student rental agreement.

  45. 23. This contract is valid for no more than one calendar year unless withdrawn or revoked, and is not transferable.

  46. 24. This contract shall be effective when approved by the university. Reapplication for a contract for subsequent years is based on the preparation of a new application and meeting all qualifications for contracted housing. No Landlord can or should anticipate that they will qualify for subsequent contracts based on receipt of prior contracts.

They need to contact our office in order to start the contracting process. Just because something has been contracted in the past, doesn t mean that the contract will be approved for a new owner.
