Consider these cases A rider has a homemade mobility device from parts obtained from a local hardware store (glued PVC pipe, coasters, etc.), the driver wants to deny the use of the mobility device in the vehicle because securement is not possible. Three persons using wheeled scooters at the bus stop was denied transportation services due to being considered a direct threat by the bus driver. A paratransit passenger asks for a round trip from point A to point B and back to point A, and the first leg of the trip is denied or missed, the passenger can t get to point B. 6

ADA Transportation Regulations Wheelchair and OMD Definition: A mobility aid belonging to any class of three or more wheeled devices, usable indoors, designed or modified for and used by individuals with mobility impairments, whether operated manually or powered. www.fta.dot.gov/documents/2011-23576.pdf 8

ADA Can t Deny the Service for Not Meeting the Definition Transportation Regulations If a transportation provider has a vehicle and equipment that meets or exceeds the Access Board s guidelines for accommodating wheelchairs, and the vehicle and equipment can, safely accommodate a given wheelchair/ mobility device, the provider cannot refuse to transport the device and its user. www.fta.dot.gov/12325_3891.html 9

  10. ADA Transportation Regulations Legitimate Safety Requirements May include a wheelchair of such size that it would: block an aisle block the vestibule be too large to fully enter a railcar, would interfere with the safe evacuation of passengers in an emergency 10

  11. ADA Transportation Regulations Legitimate Safety Requirements Does not apply to the securement of the wheelchair. A transit provider cannot impose a limitation on the transportation of wheelchairs and other mobility aids based on the inability of the securement system to secure the device to the satisfaction of the transportation provider. 11

  12. ADA Transportation Regulations Legitimate Safety Requirements Must be based on actual risks, not on mere speculation, stereotypes, or generalizations about individuals with disabilities or about the devices they use for mobility purposes. 12

ADA Transportation Regulations Direct Threat Significant risk to the health or safety of others Cannot be eliminated by a modification of polices, practices or procedures Cannot be presumed by the provision of auxiliary aids or service there must be objective evidence It does not include threats to self C.F.R. ADA Transportation Regulations No Direct Threat Speculation The transit provider must carry mobility devices, unless there is information in the record that carrying those non-traditional wheelchairs would constitute a direct threat to the safety of others. Service Animals DOJ vs. DOT Guide dog, signal dog, or other animal individually trained to perform tasks for an individual with a disability, such as guiding individuals with impaired vision, alerting individuals with impaired hearing to sounds, providing minimal protection or rescue work, pulling a wheelchair, or fetching dropped items A dog or in some cases, miniature horse, trained to perform specific tasks for an individual with a disability 15

ADA Transportation Regulations Service Animals Transit operators may ask if an animal is a service animal or what tasks the animal has been trained to perform, but cannot require special ID cards or harnesses for the animal or ask about a person s disability. Other passengers allergies and fear of animals are not valid reasons for denying transportation to people with service animals. 16

ADA Transportation Regulations Origin to Destination Service Complementary paratransit service for ADA paratransit eligible persons shall be origin- to-destination service. with the exception of certain situations in which on-call bus service or feeder paratransit service is appropriate. The decision about whether to offer door- to-door or curb-to-curb services for some individuals or locations is made by paratransit planners at the local level. www.fta.dot.gov/12325_3891.html 17

  18. ADA Transportation Regulations Trip Denials The DOT is emphasizing the importance for a standardized way of counting. In the case of requests for round trips or multiple-leg trips, if at least one trip-from point A to point B-has been denied or missed, the DOT considers that all legs of the trip are considered denied or missed. www.ada.gov/briefs/rochesbr.pdf 18
