Key policy areas in the EU Green Deal initiatives for 2021/22 include proposals on sustainable products, circular textiles, industrial emissions, mobile device environmental impacts, climate, energy, and environment state aid guidelines, and more. The EU Green Deal aims to promote sustainability and address challenges in waste management, including the revision of waste shipment regulations to ensure safe and efficient waste shipments within the EU. FEAD actively participates in providing feedback and amendments to the waste shipment regulation proposal to overcome existing bottlenecks.

Key Policy Areas in 2021/22 EU Green Deal EU Green Deal On Friday, December 11, 2020, on the one-year anniversary of the Green Deal, FEAD published its report on their contribution to the success of the European Green Deal. For the waste management industry, its activities are at crossroads with several challenges the EU Green Deal must respond to 1. Key Policy Areas in 2021/22 Waste Shipments Waste Shipments EU Waste Shipment Regulation The Commission proposed a revision of the waste shipment regulation on 17 November 2021 FEAD submitted its feedback and amendment proposals and issued a press release Main aim of FEAD is to resolve existing bottlenecks and ensure safe shipments Main risks/provisions: restriction of exports The file is currently at the EP FEAD had 2 meetings with the rapporteur s office and participated in a public hearing organised by her Draft report published in April 2022 (MEP Pernille Weiss - EPP), where most FEAD suggestions were taken Additional points were discussed with the rapporteur s office in a further meeting Deadline to table amendments was in May 2022 Vote in ENVI Committee delayed to November 2022 (December in Plenary) FEAD position to submitted amendments was shared with all MEPs in the ENVI committee and meetings are being scheduled First draft compromise that the French Council Presidency sent to national delegations at the end of June, before handing over to the Czech Republic. The document deals only with the first two titles of the draft revision of the Waste Shipment Regulation. 2. Public event with the rapporteur organised by FEAD in July 2022 (Brussels) FEAD views on amt tabled by MEPs shared with the Czech Presidency on 23rd September in Prague FEAD is exploring the option of a joint position paper with other industry stakeholders
Key Policy Areas in 2021/22 Waste Shipments Waste Shipments ADR (transport of dangerous goods by road) FEAD has been appointed since 2005 as recognized stakeholder by the RID/ADR/ADN Joint Meeting and from that date, actively participated in the development of specific waste rules in the ADR. The ADR was initially developed for dangerous goods of commercial nature and therefore did not take into account the specificities of waste. Therefore, FEAD proposed to initiate an ad hoc technical informal working group on the Transport of (hazardous) waste , which was approved with unanimity by the JM on its autumn 2018 session. In order to prepare the IWG, FEAD prepared and circulated a list of issues regarding the transport of hazardous waste. 2. Until now, 13 countries (AT, BE, DK, DE, FI, FR, IE, RO, ES, SE, CH, NL, UK) have joined the working group. FEAD takes initiatives and leads the working group. Internally, FEAD carries out its work within the Subcommittee ADR . The Informal Working Group with the Member States has already met five times and closed some of the issued in the list. The current status of each issue can be consulted here. For the last Joint Meeting (September 2022), FEAD experts finalised and submitted four INF documents Chemical compatibility for plastic packaging containing liquid waste Transport of packaged waste in combined packaging Transport of dangerous goods as waste by private individuals and presence of hazardous household waste in the (selective) collection of non-hazardous waste (e.g. empty packaging) Minutes from the fifth meeting of the Informal Working Group on the Transport of Hazardous Waste FEAD presented the four informal documents to the JM in September 2022, to receive further input from the
Key Policy Areas in 2021/22 Renewable Energies Directive (RED) Renewable Energies Directive (RED) ENVI adopted its draft opinion, as associated committee in May 2022 Discussions on restricting the use of biomass from waste FEAD prepared a position paper directed to the lead Committee FEAD joined efforts with other stakeholders (CEWEP, ESWET, COGEN) with a common letter directed to the trilogue negotiators On 27 June, EU energy ministers agreed on a "general approach". The leading committee, ITRE adopted the draft report on 13 July. The final report (after negotiations with ENVI on the shared competences) was voted on 14 September in Plenary. Some restrictions on the use of biomass from waste will continue to be addressed during Trialogue negotiations in Q4 2022 (explained to the Czech Presidency in Prague on 23rd September) First trilogue on 6 October. 3. Industrial Emissions Directive (IED) Industrial Emissions Directive (IED) The revision of the directive on industrial emissions, published on 5 April and presented to MEPs in the Environment Committee on 12 July, received a generally positive reception from MEPs. FEAD provided feedback to the Commission adopted proposal in June 2022. Rapporteur Radan Kanev (EPP) called for simplifying the obligations of industries involved in meeting CO emission reduction targets, such as battery plants. A compromise ruled out by Socialist Milan Brglez, for whom the reduction of polluting emissions is "just as fundamental for health" as that of greenhouse gases. FEAD participated to the stakeholder consultation meeting with the EU Committee of the Regions (CoR) in August 2022
Key Policy Areas in 2021/22 Emissions Trading System (ETS) At the ENVI Committee, all political groups support the inclusion of municipal waste incineration from 2026 The COM shall prepare an IA by end 2024, assessing the impact and the possibility of including in the EU ETS other waste management processes A revised Presidency compromise requires the Commission to submit a report by 31 December 2026, assessing the impact and feasibility of inclusion from 2031 (hazardous and/or municipal waste). The report shall, if appropriate, be accompanied by a legislative proposal to amend the Directive FEAD issued a press release, a position paper and submitted amendment proposals at the EP In line with the position adopted by the Board on 7 February 2022, FEAD had meetings with MEPs and the press, advocating for a prior IA as a condition for inclusion Vote in Plenary in 2022 Current negotiations with the Council under Czech Presidency. First trialogue took place on 11 July. Next rounds started in August and September. Next one on 10 October. Czech Presidency informed on FEAD views on 23rd September in Prague. 4. Ecodesign Regulation (Sustainable Products Initiative) FEAD submitted its feedback and noted that recycling activities should be more clearly addressed in this initiative Three parliamentary committees will be in charge ENVI remains the lead committee on this regulation but will share the file with IMCO and ITRE. S&D takes the lead in ENVI, with MEP Simona Bonafe as rapporteur.
Key Policy Areas in 2021/22 Batteries Regulation Batteries Regulation ITRE (Patrizia To a S&D) adopted draft opinion on 27th September 2021 IMCO (Toine Manders - EPP) adopted draft opinion on 9th December 2021 ENVI (Simona Bonafe S&D) adopted draft opinion on 10th February 2022 During a plenary session, the European Parliament adopted its negotiation on 10th March 2022 FEAD issued position papers, feedbacks, and press releases about the Committee reports and FEAD s key topics in the proposed Regulation FEAD campaigned on the Batteries regulation More than 40 meetings with MEPs or Assistants, and the EC FEAD spoke at the EUROBAT annual forum on 24 June and gave a political statement at a DUH (German environmental NGO) webconference on the EU Batteries Regulation on 5Th July FEAD final position paper on mandatory recycled content (MRC) as main point in the proposed batteries regulation, and increased collection The European Parliament and the Council of the EU adopted MRC & increased collection targets in their report/ position. The last trilogue took place on 30 June. Further rounds will take place in October 2022. FEAD views (MRC, separate collection, recovery effiency/Delegated Act) shared with the Czech Presidency on 23 September in Prague End of the negotiations delayed to Swedish Presidency (Q2 2023) 5.
Key Policy Areas in 2021/22 Waste Management and Chemicals Waste Management and Chemicals Revision of EU legislation on hazard classification, labelling and packaging of chemicals Revision of REACH Regulation to help achieve a toxic-free environment Revising Annexes IV and V to the Regulation (EU) 2019/1021 on Persistent Organic Pollutants (POPs) FEAD submitted its feedback to the EC and issued a press release The EP ENVI Committee approved on 12 July the EU compromise on persistent organic pollutants as agreed on 20 June between MEPs and the French Presidency of the EU Council. The EP may adopt agreement in October 2022 Review of the Restriction of the use of hazardous substances in electronics (RoHS Directive) simplify and strengthen the legal framework, foresees a move towards one substance one assessment Simplification and digitalisation of labelling requirements Revision of Annex I and III of Basel Convention: Annex I to the Basel Convention lists the categories of wastes to be controlled under the Basel Convention, including both specific waste categories (Y1 to Y18) and wastes having specific constituents (Y19 to Y45). Annex III to the Basel Convention lists hazardous characteristics (H1 to H13). ECHA s Risk Assessment Committee (RAC) finalized a proposal indicating that lead in metallic form should be classified as very ecotoxic for the environment, no split classification between lead in its massive form and in its powder form Material/products containing more then 2.5 ppm of lead would be classified The International Lead Association issued a position paper 6.
Key Policy Areas in 2021/22 Textile Textile Strategy Strategy Published on 30 March 2022 The Commission wants to achieve the following goals by 2030 1. Introduction mandatory Ecodesign requirements 2. Stopping the destruction of unsold or returned textiles 3. Digital Product Passport 4. Extended producer responsibility and boosting reuse and recycling of textile waste Extended producer responsibility (EPR) requirements have proven to be effective in improving separate collection of waste. Harmonised EU extended producer responsibility rules for textiles with eco-modulation of fees, as part of the forthcoming revision of the Waste Framework Directive in 2023. The key objective will be to create an economy for collection, sorting, reuse, preparation for reuse and recycling. 5. Supporting research, innovation, and investments 6. Addressing the challenges from the export of textile waste Additional point: - The Commission also encourages businesses to prioritise their efforts on fibre-to- fibre recycling. 7. Shadow rapporteurs have been appointed in the Environment Committee: Pernille Weiss (EPP), Susana Sol s P rez (Renew) and P r Holmgren (Greens) will be negotiating with Delara Burkhardt from the S&Ds, to draft the EP report on the textile strategy. FEAD issued a press release and submitted its feedback to the public consultation on the Staff Working Document Scenarios towards co-creation of a transition pathway for a more resilient, sustainable and digital textiles ecosystem FEAD identified its textile experts and created a working group for further work on this topic
Key Policy Areas in 2021/22 End of Waste: JRC and European Commission published the report Scoping and developing further end-of-waste (EoW) and by-product (BP) criteria where the priority list of waste streams for the development of EU-wide EoW criteria has been identified: Plastics (First workshop end of May) Textiles Rubber Mineral fractions of the construction and demolition wastes Paper and cardboard The Commission and JRC started the work on the development of EoW criteria for plastic waste in Q2 2022, with the finalisation of the technical assessment expected in Q1 2024. The work on EoW criteria for textile waste will commence in 2023. 8. JRC study: Separate collection of municipal waste: Development of a harmonised EU model The goal is to develop generic technical rules and detailed measures for a potential harmonisation of municipal waste collection systems in the EU. Definition of Recycling: JRC in collaboration with DG Environment presented the preliminary results of the study Assessment of the definition of recycling , within the context of the European Green Deal and the Circular Economy Action Plan 2.0. Last discussion meeting with JRC in the first half of June
Key Policy Areas in 2021/22 Taxonomy FEAD has intensively advocated for the inclusion of WtE in the Taxonomy with several position papers, press releases, meetings, events, workshops Including Waste-to-Energy in the EU Taxonomy is still not on EC agenda Report from the PSF published in March, where WtE is not included in the activities covering the objective of circulareconomy The question of a formal mandate from the European Commission to further examine under which conditions residual waste, and possibly WtE, an additional Delegated Act, again challenged by EC Commission Clear support expressed from the German authorities FEAD members are invited to contact their national authorities to ensure the needed pressure from national governments on EC FEAD views shared with the Czech Presidency on 23rd September 9.
