Protest nr: 04 Class Optimist Protestor CZE-926 - Jan Valenta Protestee CRO-1303 - Edi Jurman Witnesses Protest Committee Type protest Incident I was sailing on starboard tack very close to the finish line by the starboard RC boat and CRO 1303 was sailing on port tack in colision course to me. He got very close to me even when I tried to hail starboard to him. I couldnt avoid the collision because if I would tack I would crash into RC finishing boat. The wind was about 12 knots with moderate wave. 2.Close to the finishing line, CZE926 was on starboard and CRO1303 was on port on the collision course. 3.About one boat-length from the finishing line while they were about half a boat-length between them, CRO1303 started to tack to starboard. CZE926 luffed to avoid. 4. There was a no contact between them. 5. No boat did penalty turns. After passing head to wind and before being on a close-hauled course, CRO1303 failed to keep clear of CZE926. CRO1303 broke RRS 13. Protest nr: 05 Class Optimist Protestor NZL-4691 - Nathan Soper Protestee Witnesses Type protest Incident BZL 4691 was on starboard, POL 3656 was approaching on port NZL 4691 had to dip to avoid a collision 1 Jul 2022 at 17:40 Date/Time of hearing Location Facts found: Jury Room POL 3656 did not attend the hearing. The hearing proceeded under RRS 63.3b. In race 6 on the first upwind NZL 4691 on starboard was sailing on a collision course with POL 3656 on port. In a distance of half a boatlength NZL 4691 bore away to avoid a collision. POL 3656 on port failed to keep clear of NZL 4691 on starboard, and broke RRS 10. Protest nr: 06 Class Optimist Protestor ISV-118 - Mariana Brunt Protestee SRB-401 - Marko Adjanski Witnesses Type protest Incident I m on starboard approximately 15-20 boats lengths from RC boat on a stationary position when SRB 401 sails behind my stern and hits my rudder. At this moment I yell at him Protest. He tacked away towards RC and did not do his turns. 1 Jul 2022 at 18:00 Date/Time of hearing Location Facts found: Jury Room Procedural Matters: SRB401 did not come to the hearing, the hearing proceeded in accordance with RRS 63.3(b). Facts found: 1. The wind was about 12 knots with moderate wave. 2.Less than 1 min to start race 6, while ISV118 was stationary behind the starting line, SRB401 sailed toward ISV118 and hit ISV118 at her rubber. 3. There was no damage and no boat did penalty turns. SRB401 clear astern failed to keep clear of ISV118 clear ahead, and broke RRS 12. Protest nr: 08 Class Optimist Protestor OMA-211 - Abdul Latif Mohammed Protestee POL-3655 - January Szczukowski Witnesses UAE-86 - Saif Alzaabi Type protest Incident In race 8, while rounding the gate on port, POL 3655 was overlapped outside of OMA 211. OMA 211 asked for room and POL 3655 grabbed the gangwhale of OMA 211 and pushed her back, propelling herself forward. By pushing OMA 211 back and propelling her boat forward, POL 3655 did not compete by using only the wind and water to increase her speed, breaking RRS 42.1 Furthermore, by pushing another boat back, POL 3655 violated the recognized principles of sportsmanship and fair play 4 Jul 2022 at 19:20 Date/Time of hearing Location Facts found: Jury Room 1. Protest nr: 09 Class Optimist Protestor ROU-100 - TUDOR DEMUSCA Protestee RC - Miguel Amaral Witnesses Type request for redress Incident Final results are wrong. 5 Jul 2022 at 18:15 Date/Time of hearing Location Facts found: Jury Room ROU 100 finished the race 9 in 58th position. 15:30 the Race Commitee published a result list where ROU 100 was DNC. 15:40 the Race Commitee published a new list where ROU 100 finished race 9 in position 58. The hearing was held without the requestor under RRS 63.3(b). Conclusion: There was neither an improper action nor omission of the race committee. Protest nr: 11 Class Optimist Protestor CRO-1311 - Luka Dokoza Protestee CAN-1818 - Andi Kinnear Witnesses Type protest Incident 30 seconds before starting signal of 11th race CAN 1818 came on my leeward side and pull backwards my boat with his hand. By his action I was moved from my position on starting line and I was prevened to start correctly. 6 Jul 2022 at 17:15 Date/Time of hearing Location Facts found: Jury Room Before the start CAN was clear astern of CRO. CAN 1818 became overlapped to leeward of CRO 1311 30 secs before the start. CAN s course was about 20 degrees below CRO s, and CRO s course was slightly above close-hauled. CAN then luffed to a course about 20 degrees below head-to-wind and CRO responded, luffing to the same course. When they stopped luffing the gap between the hulls was about 15 cm. This gap then reduced, and after between 3-7 seconds the hulls made contact. To avoid risk of hull damage CAN fended off CRO with his hands which caused CRO to move slightly backwards. When CAN 1818 as leeward right of way boat luffed, CRO 1311 promptly responded but was unable to keep clear. Protest nr: 12 Class Optimist Protestor PER-380 - Salvador Marchena Ortega Protestee CAN-1818 - Andi Kinnear Witnesses CHI-670 - Juan Pablo Ramirez Type protest Incident I was saling on portside after the start. I had wind turbency, because OF a boat on top OF me, and Can 1818 was about 6 boat lenghts windward OF me. Then i tacked, completed my manuover, and was on upwind course. After this i yelled starboard to the boat from ca ada, he responded if he could pass and i clearly answered no. After this i tr ed to void him, but because OF the wind condici n, i still had contact with him. Making me lose my posicion. And breaking rule 10 6 Jul 2022 at 17:40 Date/Time of hearing Location Facts found: Jury Room CAN 1818 retired from race 12. PER 380 requested to withdraw the protest. There is no reason to refuse the request to withdraw the protest. Protest nr: 13 Class Optimist Protestor ARG-3939 - Felix Llaur Protestee DEN-8724 - Aksel Berg Madsen Witnesses Type request for redress Incident I was approaching the first mark of the regatta and the boat carried out a penalty of 2 turns and to avoid it I had to turn aggressively causing an injury to my leg. Until that moment I was only in position number 17 approximately and when I was injured and sailed with 18 knots, the injury caused me to fall to position 53. I have my test knee and the boat track. 6 Jul 2022 at 18:00 Date/Time of hearing Location Facts found: Jury Room ARG 3939 submitted a Request for Redress following an incident near Mark 1 with DEN 8724 in which he alleged he suffered an injury that affected his speed thereafter in the race. Under rule 64.1(c) the PC changed it to protest and Request for Redress After the incident ARG sailed three legs and finished, and then did not inform the RC of intention to protest. Protest invalid. SI 1.4 not complied with. No boat is penalised. Therefore rule 62.1(b) did not apply.
