The Special Education Division is responsible for assigning annual determinations to Local Education Agencies (LEAs) in the state, based on specific criteria and performance indicators. Annual Determinations (ADs) are essential for evaluating LEAs' compliance with the Individuals with Disabilities Education Act (IDEA) and ensuring effective education delivery for individuals with disabilities.

  2. Annual Determinations (ADs) The State is required to assign annual determinations (AD) to all Local Education Agencies (LEAs) each year. Individuals with Disabilities Education Act (IDEA) at 34 CFR 300.600(a)(2) and Subsection F of 6.31.2.9 NMAC. LEAs are school district state charter school and State Supported Schools (SSSs) Investing for tomorrow, delivering today. 2

  3. Determination Categories The Special Education Division is required to make annual determinations about the performance of all local education agencies (LEAs) in the state. Four categories are used for assigning categories: Meets Requirements - meets the purposes and requirements of IDEA B. Needs Assistance - in implementing the requirements of Part B Needs Intervention - in implementing the requirements of Part B Needs Substantial Intervention - in implementing the requirements of Part B Investing for tomorrow, delivering today. 3

  7. Changes to the LEA Annual Determination Matrix State is proposing changes to the LEA Annual Determination Matrix To establish clear criteria for each category. Add target indicators to the matrix Remove duplicative criteria Investing for tomorrow, delivering today. 7

  8. Role of the Stakeholder in the SPP/APR Process As part of the SPP/APR, Stakeholders must be included in the following activities: a. Target setting for SPP/APR indicators b. Analyzing SPP/APR data c. Providing strategies for improving outcomes for children and youth with disabilities, d. Evaluating the progress the State is making Objective for today is: Stakeholders to share feedback and ideas for improving outcomes for students with disabilities. The state will record feedback and share with internal stakeholders that have a role in decision making. Investing for tomorrow, delivering today. 8

  9. Term Review OSEP: Office of Special Education Programs. Oversees the implementation of the Individuals with Disabilities Education Act, Part B IDEA Part B: Individuals with Disabilities Education Act, Part B which outlines the requirements for serving students with disabilities for ages 3-21 SPP/APR: State Performance Plan where the state establishes baselines and targets. Annual Performance Report where the state reports progress on baselines and targets. Indicator: Each requirement reported in the SPP/APR is called and indicator. Each indicator is assigned a number, 1 through 16. Baseline: Data starting point Target: Rate the State has set to meet for each target indicator Met Target: The target the State has established was met or exceeded. Did Not Meet Target: The target the state has established was not met. Lag Year: Data from year prior than reporting. Investing for tomorrow, delivering today. 9
