Order passed by Full Council Committee 5/4/2020
915 Properties out of 3200 identified as Privately rented
within the South Wigston Ward
The South Wigston Ward fails in five categories; and is only not included in the
category for high level migration
Low housing demand (or is likely to become such an area e.g. negative house
prices);
There is a significant and persistent problem caused by anti-social behaviour;
There are poor property conditions;
There are high levels of deprivation (and morbidity); and
There are high levels of crime.
11 properties failed EICR on application
3 failed EPC certificate
1 failed party wall fire protection
All rectified prior to issuing of licence
2 Major developments being addressed as a whole
within the Borough containing 28 units
Grants available for Landlords to improve EPC to D
with OWBC paying 50% grant
Enforcement
Legal requirement to register since 5/5/2020
6 Months allowed due to Covid ended 5/11/2020
Now pursuing 135 Estate Agents and Letting
Agents by service of Housing Act 235 notice to
provide details of properties
Issuing Civil penalty for none compliance and
failure to provide documents
1 Year licence being issued to rectify errors.
Landlords will have to register for end of term
licence on completion of works.
The requirement to Licence is a legal mandatory
requirement
The Council will pursue all privately rented property
owners /responsible persons to licence
Enforcement options are through Civil penalties up
to £30,000 per offence
Appeals to the Residential Property Tribunal
