Emerging issues in the implementation of the RTI Act include the inadequate staffing of information commissions, non-compliance with orders, and lack of attention from higher authorities. The challenges also extend to training, proactive disclosure, and legal issues. Recommendations are put forth to address these issues and improve the functioning of the Act.

  2. Full strength of Commission: situation far from satisfactory in many of the states 1. Posts not filled in time 2. Legal issues: invalidations of appointments 3. Court s intervention.

  3. Appointment of subordinate staff. Positions lying vacant 1. Overall shortage of staff in Commissionerates 2. Low priority in deployment of staff 3. Outsourced employees and their issues

  4. Compliance of Commissions orders 1. Still it is a major bottleneck 2. Compliance reports not submitted in time. 3. Lack of seriousness by Public Information Officers (PIOs) and Appellate Authority 4. Frequent transfers of Public Information Officers (PIOs)

  5. Little attention by higher authorities 1. Implementation is left to PIOs who is a junior officer in the hierarchy 2. Heads of public authorities are averse and apathetic to the operational issues 3. PIOs over burden and unable to justify the task assigned to them

  6. Training of staff working as PIO/First Appellate Authority 1. PIOs are not adequately sensitized and trained for their duty. 2. Lack of training resources in regional language. 3. PIOs are not relieved to attend the training programmes at the last moment.

  7. Proactive Disclosure 1. Periodical scrutiny and updation still a problem 2. Situation at Village Panchayat level is far from satisfactory. 3. Lack of monitoring from higher level.
