Caring and Safe Schools Every child is entitled to feel safe in the classroom, in the hallways of school and on the playground. Children go to school to learn, and educational opportunity must be the great equalizer in America. No matter what your race, sex or zip code, every child is entitled to a quality education and no child can get a quality education if they don t first feel safe at school. --U.S. Secretary of Education Arne Duncan, August 2010 Board Policy BP 5145.4 on Anti- Bullying adopted 5/8/12 Bullying is a school safety issue. California Teaching Standard 2.1: Promoting social development and responsibility within a caring community where each student is treated fairly and respectfully California Teaching Standard 2.3: Establishing and maintaining learning environments that are physically, intellectually, and emotionally safe
The Problem of Bullying The Problem of Bullying Academic problems affects achievement and attendance Social problems increase in behavior problems for offending students and targeted students Emotional problems increase in adjustment problems, aggression, anxiety, depression, and self-inflicted violence School safety suicide and school shootings Parent concerns Perception that school/teacher didn t do anything Media attention Legislative mandates are growing Bullying, if left unchecked, can lead to serious and costly consequences for a school
Seths Law Seth s Law AB 9 effective July 1, 2012 AB 9 All California School Personnel are required to take immediate steps to intervene whenever he or she witnesses Discrimination Harassment Intimidation Bullying Schools are required to have procedures and timelines for documenting and responding to reports of bullying. NOTE: If a school fails to protect a student from being targeted because of a protected characteristic, it is liable to be sued.
What is Bullying? What is Bullying? Behavior (any gesture or written, verbal, graphic, physical, or electronic act) that is: Intended to harm Involves an imbalance of power, strength or status; and Involves a pattern of behavior repeated over time OR an extreme or severe act Olweus research on bullying
When Bullying = Harassment When Bullying = Harassment Harassment is when a student is targeted because he or she has or is perceived to have a protected characteristic: Race, disability, or gender Ethnic group, national origin, color, religion, actual or perceived sexual orientation and gender identity If a school fails to protect a student from being targeted because of a protected characteristic, it is liable to be sued.
Immediate Steps to Intervene Immediate Steps to Intervene Stop the bullying or harassment Correct or redirect the offending student(s) Receive report from targeted student Documentimmediately if harassment, safety risk or severe act, within 24 hours if not a safety risk Forward report to Administrator immediately if harassment, safety risk or severe act, within 24 hours if not a safety risk AB 9 - All California School Personnel are required to take immediate steps to intervene whenever he or she witnesses discrimination, harassment, intimidation or bullying
