  2. Chapter objectives: Chapter objectives: Explain the wisdom behind the legislation of marriage. Explain the basics of choosing Husband and wife. mention the conditions of a marriage contract. Differentiate from between the rights of husband and wife. know of new marriage contracts.

  3. The wisdom behind legislating marriage: The wisdom behind legislating marriage: 1. Society building. -Marriage is the main building block of a society Thus islam encourages us to get married: Hadeeth: O young men, whoever among you can afford it, let him get married, for it is more effectice in lowering the gaze and guarding one s chastity (AL Bukahri).

The wisdom behind legislating marriage: The wisdom behind legislating marriage: 2. protecting the society: Through marriage, chastity, tranquility, stability and distancing one away from sins (haraam) is achieved. Marriage results in one protecting himself from contagious diseases thus protecting the society from these illnesses. Marriage also fortifies the society against disintegration by strengthening relations between families (in laws) and tribes.

Progeny is a desired result in Sharia which can only be achieved through nikah (marriage). 4. Attaining Human stability: Once married and being blessed with children, emotions of father hood and mother hood begin to grow, sacrifices come at the forefront as bringing up children and fulfilling the demands(rights) of the family come at the forefront. Thus spouses start leadin a life of mutual responsibilty and begin to attain stability in its finest form.

The The basic of choosing spouses: basic of choosing spouses: 1.Religion and 2. good morals: Hadeeth: A woman may be married for four things: her wealth, her lineage, her beauty and her religious commitment. (may you ) prosper by seeking the one who is religiously commited . Hadeeth: if there comes to you one whose religious commitment and attitude (charcter) plaese you, the marry (your female relative who is under you) to him, for if you do not do that, there will be tribulation on earth and much corruption . (At Tirmidhi). From the above we understand the first thing we should consider in choosing a spouse is his / her religious commitment and good morals.

  7. The basic of choosing spouses: The basic of choosing spouses: 3. compatibilty: We were encouraged in Islam to marry compatible women. Compatibility between spouses means similarity in education level ( family status in society , family profession and financial status) and age. As this increases the chances of harmony and afinity (love). Also it help in the continuity of co-existence and family preservation.

Types of modern marriages and its ruling: Some type of modern marriages include but are not limited to: Az zawaj as Suri ( sham marriage) e.g: marrying with the intention of getting the nationality of a country. Az zawaj al Misyar : A marriage where the wife dissolves her rights of living together, finance e.t.c Az zawaj biniyyati talaq (marrying with the intention to divorce. Online marriage Ruling: each type has it s ruling depending wether it fulfills the requirements of Sharia (islamic law ).

  10. Marital rights: Rights of the husband: 1. Wife should obey her husband in all things that do not involve disobeying Allah. 2. Staying at her husband s house. 3. Not allow someone in her husband s house whom he dislikes. 4. Preserve the husband s honour ,wealth and children. Rights of the wife: 1. Spend on his wife (shelter, clothing, food and medication) 2. Good companionship ( treat them with kindness,avoid embarrassing or humiliating her) 3. Preserving her honour, appreciating and protecting her.

  11. Marital rights: Common rights: tolerance , mutual respect and cooperation. to enjoy and benefit from each others company (in permissible ways). Prohibition of marrying the spouse s blood relatives. (check page 82 in your Islamic text book for more details). confirmation of children s lineage. Inherit from each other.
