What is Producer Responsibility? Extension of the Polluter Pays principle Businesses are responsible for the end of life environmental impact of their products Packaging, electrical and electronic equipment (EEE), batteries and end of life vehicles (ELV)
Pro Res and Vapes Vapes are EEE Waste Electrical and Electronic Equipment Regulations 2013 Vapes contain batteries The Waste Batteries and Accumulators Regulations 2009 Vapes are packaged The Producer Regulations 2007 The Packaging Waste (Data Reporting) Regulations 2023 Responsibility Obligations (Packaging Waste) 3
WEEE Regulations Encourage re-use, recycling and recovery Producers of EEE must register annually Who are EEE producers? - manufacture and sell EEE under your own brand in the UK, or - resell equipment made by someone else under your own brand, or - import EEE on a commercial basis into the UK, or - are established outside of the UK and supply EEE directly to the UK market by distance selling 4
WEEE How to comply EEE tonnages placed on the market in the previous calendar year < 5 tonnes = small producer > 5 tonnes = large producer Register with your environmental regulator or a PCS Join a Producer Compliance Scheme (PCS) Report how much EEE you placed on the market Report how much EEE you placed on the market Pay the registration fee Pay PCS fees, which include WEEE collection/treatment costs 5
Batteries Regulations Minimising harmful effects on the environment Producers of batteries must register annually Who are batteries producers? - have a UK business presence, and - first person in your selling chain (including importers) to make batteries available for supply or sale on the UK market - includes batteries already in electrical appliances 6
Batteries How to comply Portable battery tonnages placed on the market < 1 tonne = small producer > 1 tonne = large producer Register with your environmental regulator Join a Battery Compliance Scheme (BCS) Submit data on the batteries you placed on the market Submit data on the batteries you placed on the market Pay the annual charge Pay BCS fees, which include battery collection/treatment costs 7
