Definitions: Covered Products Packaging & containers Consumer products Service packaging (take-out/ delivery food packaging) Rx bottles Paper products Except bound books
Definitions: Producer Manufactures, sells, distributes or imports covered product under its own name/ brand in Maryland Imports covered product as a licensee/ franchisee who sells or distributes in MD
Definitions: Stewardship Org & Plan Stewardship Organization Nonprofit organization created by group of producers to implement stewardship plan Stewardship Plan Plan developed by stewardship organization to address covered products and materials
Main Points Goals: Waste reduction Producers help local govts cover costs associated with managing residential waste & recycling Process: Producers band together to create a stewardship organization Producers of covered products must submit a stewardship plan to MDE
Stewardship Plan: Components Membership List all producers and brands covered by stewardship plan Performance goals Post-consumer recycled material content rates Recycling rates % of products readily recyclable or compostable Implementation plan Describe how performance goals will be met or exceeded Stakeholder engagement How stakeholders (local Govt, recyclers, haulers, etc) were engaged in the development of the stewardship plan
Stewardship Plan: Components Staffing How the staffing and administration of the plan will be handled Product design Describe how producers will work together to reduce packaging through better product design Plan for public outreach and communication To promote proper end-of-life management and prevent litter Methods of financing Fees structure for members to cover costs of implementation, administration, and reimbursing local govts Incentives to encourage producers to waste and recyclability (+disincentives)
Accountability Reporting requirements Producers submit reporting to MDE Public website Prohibition to sell, import, or distribute if not part of product stewardship organization or submitting independent product stewardship plan Civil penalties Financing subject to independent audits Regular re-authorization of Stewardship plans
