INTERFERENCE IN THE WORK OF THE SEC 100 INTERVENTION TEAM AND ENGAGING CORRUPT PRACTICES AND MISMANAGEMENT OF GOVERNMENT RESOURCES IPID North West has not received cases with allegations relating to interference with the work of the committee, corrupt business practices or mismanagement of government resources in relation to the SAPS 3

  4. INVESTIGATIONS RELATING TO THE NORTH WEST HAWKS TEAM IPID has a total of 5 cases investigated against the North West General Mabula team. Out of the 5 cases 3 are on the court roll 1 is still awaiting review decision by DPP 1 is still under investigation 4

  5. INVESTIGATION DETAILS OF THE CASE STATUS OUTSTANDING 1. General Mabula, General Makhele, General Motswenyane, Brigadier Moyane, Brigadier Kgorane, Col Dawood, During the investigation into allegations of corruption and money laundering against Lt General Phahlane, Lt General Phahlane allegedly abused his power as Acting National Commissioner and in conspired with Mabula team to defeat the ends of interfere with investigation (Sinoville 534/05/2017). The case was resubmitted to the DPP for decision after an initial decision was taken not to prosecute in the matter. IPID submitted this matter to the NDPP for review. This matter is now handled by the Investigating Directorate(ID) of the NPA. Outcome of the review is still outstanding justice and IPID CAS Sinoville CAS 534/05/2017 Linked investigation of corruption and money investigation against General Phahlane and service providers at the FSL. to R96 Million laundering 5

  6. INVESTIGATION DETAILS OF THE CASE STATUS OUTSTANDI NG Investigation into allegations of murder against General Mabula and his team relating to (Akasia CAS 123/06/2006). After theft 14 million rand from Benoni as per Benoni Cas 860/05/2006, Organised Crime Unit from North West Province under General Mabula was deployed by General Richard Mdluli to investigate the case. The Unit arrested Solomon Nengwana with the view of interrogating him. Solomon Nengwana was taken to Mmakau SAPS where he was interrogated and subsequently tortured until he died. Members took the deceased to hospital and allegedly informed the doctor that the deceased was breathing when they brought him in. The doctor contradicted their version and stated that the deceased died two to three hours before he was brought to the Hospital since rigor mortis was in an advanced stage. 2 General Mabula, Brigadier Kgorane, Col Manamela (Deceased), Col Dawood, Captain Mdluli, W/O Moahloli, Captain Makutu, Capt Makhubu and W/O Kutumela CCN 2006060342 The NPA decided that a formal inquest was held on the 14 April 2021 at Brits Magistrate court. The inquest has now been to 20 to 23 September 2021 for hearing. This matter is now handled by the Investigating Directorate(ID) of the NPA. 6

INVESTIGATION DETAILS OF THE CASE STATUS OUTSTA NDING 3 General Mabula, Brigadier Kgorane, Col Manamela (Deceased), Col Dawood, Captain Mdluli, W/O Moahloli, Captain Makutu, Capt Makhubu and W/O Kutumela Investigation into allegation of torture against General Mabula and his team. Hillbrow CAS 988/06/2018. The connected to 123/06/2006. The DPP decided to prosecute and that the matter must be heard in the High Court. The defence made representations to the DPP, the representation was declined by the DPP. The case appeared for the first time on the 20 December 2020 case is Akasia CAS The case is postponed to the 16 April 2021 for Pre trial hearing and outcome of further representations to NDPP. The NDPP declined the representation, the case has been postponed to 08 November to 10 December 2021 for trail. This matter is now handled by the Investigating Directorate(ID) of the NPA. INVESTIGATION DETAILS OF THE CASE STATUS OUTSTAN DING Captain Dawood, Sgt Kutumela, Constable Pebana, W/O Matthyser, W/O Vermeulen, Constable Mosala, W/O Tshiponyane and Captain Mano (deceased) Orkney CAS 5/04/2008 Klerksdorp CAS 113/02/2010 4 Investigation into allegation of torture against members of Serious and Violent Crime units which then resorted under Major General Mabula who was by then holding the rank of Director. Most of the victims in these cases were police officers based at the different units and police stations within the North West province. The victims were allegedly tortured and be forced to confess or admit to the commission of the alleged offences. The victims were arrested on allegations of ATM bombing, all cases against them were withdrawn. During 2010 the cases were referred to North Gauteng DPP wherein Adv Mrwebi decided that the involved members be criminally prosecuted and that J50 warrants be issued. J50 s warrant of arrests were issued and executed against Captain Dawood, Sgt Kutumela, Constable Pebana, W/O Matthyser, W/O Vermeulen, Constable Mosala, W/O Tshiponyane, Captain Mano in 2010.   9. Continues.. INVESTIGATION DETAILS OF THE CASE STATUS OUTSTAN DING . Klerksdorp CAS 94/04/2010 4 NPA decided to charge Warrant Officer Kutumela and Lieutenant Colonel Dawood. The case is currently on the court roll and has been postponed to the 28 June to 09 July 2021 for further trial.   10. INVESTIGATION DETAILS OF THE CASE STATUS OUTSTANDING 5 Col Dawood, W/O Tshipunyana Investigation allegation of death as a result of police action. The were chasing robbery suspects. There was an exchange of shots between the police and suspects. police shot and killed one of the suspects into Investigation completed. At this stage the shooting appears to be justified.
