INTRODUCTION
MORE THAN 370 MILLION INDIGENOUS PEOPLE LIVE IN 70 NATIONS AROUND THE WORLD,
ACCORDING TO ESTIMATES. THEY MAINTAIN SOCIAL, CULTURAL, ECONOMIC, AND
POLITICAL QUALITIES THAT ARE DISTINCT FROM THOSE OF THE DOMINANT
COMMUNITIES IN WHICH THEY RESIDE BY FOLLOWING DISTINCTIVE TRADITIONS. THEY
ARE THE DESCENDANTS - SPREAD ACROSS THE GLOBE FROM THE ARCTIC TO THE SOUTH
PACIFIC. THOSE WHO LIVED IN A COUNTRY OR A GEOGRAPHICAL REGION DURING THE
TIME WHEN PEOPLE OF DIFFERENT CULTURES OR ETHNIC BACKGROUNDS CAME,
ACCORDING TO A STANDARD DEFINITION. THROUGH CONQUEST, OCCUPATION,
SETTLEMENT, AND OTHER WAYS, THE NEWCOMERS EVENTUALLY BECAME DOMINANT.

DEFINITION OF THE TERM INDIGENOUS
GIVEN THE MULTIPLICITY OF INDIGENOUS PEOPLES, NO UN-SYSTEM ENTITY HAS
ESTABLISHED AN OFFICIAL DEFINITION OF "INDIGENOUS." INSTEAD, BASED ON THE
FOLLOWING, THE SYSTEM HAS ESTABLISHED A MODERN INTERPRETATION OF THE TERM:
AT THE INDIVIDUAL LEVEL, SELF-IDENTIFICATION AS INDIGENOUS PEOPLES AND
ACCEPTANCE AS A MEMBER OF THE COMMUNITY.
 STRONG TIES TO TERRITORIES AND NATURAL RESOURCES IN THE REGION.
 HISTORICAL CONTINUITY WITH PRE-COLONIAL AND/OR PRE-SETTLER SOCIETIES.
 FORM NON-DOMINANT SOCIAL, ECONOMIC, OR POLITICAL GROUPS.
AS UNIQUE PEOPLES AND COMMUNITIES, RESOLVE TO PRESERVE AND RECREATE THEIR
ANCESTRAL HABITATS AND SYSTEMS.

THE TRADITIONS OF THE INDIGENOUS PEOPLE
INDIGENOUS PEOPLES HAVE THEIR OWN LANGUAGES, KNOWLEDGE SYSTEMS, AND
BELIEFS, AND THEY HAVE PRICELESS UNDERSTANDING ABOUT HOW TO MANAGE
NATURAL RESOURCES SUSTAINABLY. THEY HAVE A UNIQUE RELATIONSHIP WITH AND
USE OF THEIR ANCESTRAL LANDS. THEIR ANCESTRAL LANDS ARE CRITICAL TO THEIR
COLLECTIVE PHYSICAL AND CULTURAL SURVIVAL AS PEOPLES. INDIGENOUS PEOPLES
HAVE A VARIETY OF DEVELOPMENT CONCEPTS BASED ON THEIR TRADITIONAL VALUES,
GOALS, NEEDS, AND PRIORITIES.

THE DECLARATION OF UNITED NATION ABOUT INDIGENOUS PEOPLE
THE CONVENTION RELATING TO THE STATUS OF INDIGENOUS PEOPLES (THE
DECLARATION) ESTABLISHES BASELINE REQUIREMENTS FOR INDIGENOUS PEOPLES'
SURVIVAL, DIGNITY, SECURITY, AND WELL-BEING AROUND THE WORLD, AS WELL AS THE
RIGHT TO BE DIFFERENT. THE DECLARATION WAS ADOPTED BY THE UNITED NATIONS
GENERAL ASSEMBLY IN SEPTEMBER 2007. THE DECLARATION CAN BE TAKEN AS A GUIDE.
THE DECLARATION IS THE MOST COMPLETE WEAPON WE MUST PROMOTE AND
PRESERVE ABORIGINAL AND TORRES STRAIT INDIGENOUS PEOPLES' RIGHTS.

HIERARCHY OF PEOPLES OR PERSONS BASED ON NATIONAL ORIGIN, RACIST, RELIGIOUS,
ETHNOGRAPHIC, OR SOCIOECONOMIC DISPARITIES ARE RACIST, SCIENTIFICALLY INCORRECT,
LEGALLY INEFFECTIVE, ETHICALLY REPUGNANT, AND SOCIALLY INEQUITABLE. REAFFIRMING THAT
INDIGENOUS PEOPLES SHOULD BE FREE OF ALL KINDS OF BIGOTRY IN THE EXERCISE OF THEIR
RIGHTS.

THE 2010 INTERIM REPORT OF THE ILA COMMITTEE ON THE RIGHTS OF INDIGENOUS
PEOPLES UPDATED THE SEARCH FOR STATE PRACTICE AND OPINION JURIS AND
SUPPORTED THE EARLIER FINDINGS, INCLUDING THE DISCOVERY OF CUSTOMARY
INTERNATIONAL LAW, INCLUDING THE RIGHT TO AUTONOMY OR SELF-GOVERNMENT,
WITH EVER MORE EXAMPLES OF DOMESTIC AND INTERNATIONAL PRACTICES. THE RIGHT
TO CULTURAL IDENTITY RECOGNITION AND MAINTENANCE; THE RIGHT TO CUSTOMARY
LANDS AND NATURAL RESOURCES; AND THE RIGHT TO RESTITUTION AND REDRESS FOR
WRONGS COMMITTED 92. THE WORLD IS CHANGING SO THE REFORMS AND LAWS OUGHT
