Code of Student Conduct & Discipline http://www.laredo.edu/cms/codeofstudentconductanddiscipline/ Tobacco Use Student Code FLBD (LEGAL & LOCAL) Senate Bill 21 modifies the law to raise the minimum age from 18 to 21. At Regulation Prohibited, a college district is prohibited from adopting or enforcing requirements related to the lawful age to sell, distribute, or use cigarettes, e-cigarettes, or other tobacco products that are more stringent than the requirements of the bill. Possession and Use Prohibited Unless subject to an exception under law, an individual who is younger than 21 years of age commits an offense if the individual: Possesses, purchases, consumes, or accepts a cigarette, e-cigarette, or tobacco product; or Falsely represents himself or herself to be 21 years of age or older by displaying proof of age that is false, fraudulent, or not actually proof of the individual's own age in order to obtain possession of, purchase, or receive a cigarette, e-cigarette, or tobacco product.   4. Discipline and Penalties FM (LEGAL) Discipline and Penalties House Bill 449 The college district must add a transcript notation if a student is determined to be ineligible to reenrolled. If a student withdraws from a postsecondary educational institution, including a college district, pending disciplinary charges that may result in the student becoming ineligible to reenroll in the institution for a reason other than an academic or financial reason, the institution may not end the disciplinary process until the institution makes a final determination of responsibility, including, if applicable, a determination of whether the student will be ineligible to reenroll in the institution for a reason other than an academic or financial reason. If, as a result of the disciplinary process, the student is ineligible to reenroll in the institution for a reason other than an academic or financial reason, the institution shall include on the student's transcript the notation required under Education Code 51.9364(b) [see FJ]. Title IX a clause in the 1972 Education Act stating that no one shall because of sex be denied the benefits of any educational program of activity that receives direct federal aid Supreme Court decisions and guidance from the U.S. Department of Education have given it a broad scope covering sexual harassment and sexual violence. Under Title IX, schools are legally required to respond and remedy hostile educational environments and failure to do so is a violation that means a school could risk losing its federal funding. No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.

Title IX FFDA (LEGAL) Freedom from Discrimination, Harassment, and Retaliation: Sex and Sexual Violence Senate Bill 212 establishes a reporting structure, at Reporting Required, from an incident of sexual harassment, sexual assault, dating violence, or stalking that is alleged to have been committed by or against an enrolled student or by or against an employee. The bill amends the definitions of Dating Violence, Sexual Assault and Stalking. Not properly reporting a claim is a Class B misdemeanor and punishable by up to 180 days in jail and a $2,000 fine. If the person is found to have intentionally withheld the report, the crime becomes a Class A misdemeanor and the punishment increases to a maximum of $4,000 and one year in jail. A postsecondary educational institution shall terminate the employment of an employee whom the institution determines in accordance with the institution s disciplinary procedure to have committed the offense. Title IX Definitions "Dating violence," "sexual assault," and "stalking" have the same meanings assigned by the Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act, 20 U.S.C. 1092(f)(6)(A). Education Code 51.251(2), .281(2); 19 TAC 3.3(c) Dating violence" means abuse or violence, or a threat of abuse or violence, against a person with whom the actor has or has had a social relationship of a romantic or intimate nature. Education Code 51.9365(a)(1); 19 TAC 3.13(a) "Sexual assault" means sexual contact or intercourse with a person without the person's consent, including sexual contact or intercourse against the person's will or in a circumstance in which the person is incapable of consenting to the contact or intercourse. Education Code 51.9365(a)(3); 19 TAC 3.13(c) "Stalking" means a course of conduct directed at a person that would cause a reasonable person to fear for the person's safety or to suffer substantial emotional distress. Education Code 51.9365(a)(5); 19 TAC 3.13(e) "Sexual harassment" means unwelcome, sex-based verbal or physical conduct that: In the employment context, unreasonably interferes with an employee's work performance or creates an intimidating, hostile, or offensive work environment; or In the education context, is sufficiently severe, persistent, or pervasive that the conduct interferes with a student's ability to participate in or benefit from educational programs or activities. Title IX FFDA (LEGAL) Freedom from Discrimination, Harassment, and Retaliation: Sex and Sexual Violence House Bill 1735 - The bill expands upon the policy training requirements for entering freshmen and undergraduate transfer student to include the new policy statements and to allow the training to be offered online. Training - Each postsecondary educational institution shall require each entering freshman or undergraduate transfer student to attend an orientation on the institution's sexual assault policy before or during the first semester or term in which the student is enrolled at the institution. The institution shall establish the format and content of the orientation. Overdose Awareness FKC (LEAGAL) Student Activities Registered Student Organizations House Bill 3285 requires college district that require residential advisors or student organizations officers to receive training to also receive Overdose Awareness Training. A public or private institution of higher education, including a college district, that imposes any mandatory training requirements on officers of student organizations must ensure that overdose awareness and appropriate response training is included with that training. "Student organization" includes any organization that is composed mostly of students enrolled at a public or private institution of higher education and that is registered with the institution; receives student organization resource fee revenues or other funding from the institution; or is otherwise recognized as a student organization by the institution.
