DEFINITION SEXUAL HARASSMENT WHAT TO LOOK FOR AN EMPLOYEE CONDITIONING AN AID, BENEFIT, OR SERVICE OF THE DISTRICT ON AN INDIVIDUAL S PARTICIPATION IN UNWELCOME SEXUAL CONDUCT (I.E., QUID PRO QUO) UNWELCOME CONDUCT DETERMINED BY A REASONABLE PERSON TO BE SO SEVERE, PERVASIVE, AND OBJECTIVELY OFFENSIVE THAT IT EFFECTIVELY DENIES A PERSON EQUAL ACCESS TO THE DISTRICT S EDUCATION PROGRAM OR ACTIVITY (I.E., HOSTILE ENVIRONMENT) SEXUAL ASSAULT, DATING VIOLENCE, DOMESTIC VIOLENCE, OR STALKING, AS THESE TERMS ARE DEFINED IN FEDERAL LAW

Old standard The school or district was held liable when someone with the authority to do something about it was made aware of the allegation New Standard The school or district is held liable when ANY employee is made aware of the allegation USDE to a child, an adult is an adult

REPORTING WHAT TO DO ANYTIME YOU FIND YOURSELF WITH KNOWLEDGE OF SEX-BASED HARASSMENT YOU SHOULD REPORT IT TO THE DISTRICT S TITLE IX COORDINATOR IF THE COORDINATOR DETERMINES THAT THE BEHAVIOR WOULD MEET THE DEFINITION OF SEXUAL HARASSMENT UNDER TITLE IX THEN THE FORMAL PROCEDURE WILL BE FOLLOWED. IF IT DOES NOT, THE BEHAVIOR WILL STILL BE ADDRESSED BUT WILL FALL UNDER NORMAL PROCEDURE/GUIDELINES SAY SOMETHING WHEN IN DOUBT, REPORT!
