When to do a DBS Check The law specifies what roles we can carry out a DBS Check for, and what level of check we can carry out. The Counter Signatory is responsible for ensuring that the check is allowed and at the appropriate level.
Levels of Check Standard - for positions listed in the Rehabilitation of Offenders Act 1974 (Exceptions) Order 1975 Enhanced - for positions listed in BOTH the above and the Police Act 1997 (Criminal Records) regulations Enhanced with barred list check for positions eligible for an enhanced check as above and specifically listed in the Police Act regulations as able to check the appropriate barred list(s) You can check the legislation at www.legislation.gov.uk, however the DBS do provide an online eligibility checker, which in most cases will tell you the level of check allowed for a role. https://www.gov.uk/find-out-dbs-check
Before you ask for a check Check that the role is eligible for a check The online checker will ask a series of questions which you need to answer in respect of the role Here is a sample check of the eligibility checker
What not to do When answering the questions ensure to answer them honestly. Do not try to over-exaggerate the role because you think that it should have a check. e.g. If someone is assisting someone to get to the toilet, but not actually providing personal care, when the eligibility checker asks this is not considered helping them go to the toilet
How to do a check You need to create a role profile for any role where you intend to request a DBS check. RVS can help with templates / checking that the profile is detailed enough. Once you have a suitable role profile call HR on 01252 398423 or 01252 398425. You will be asked a series of questions which the role profile should help you to answer.
Call 01252 398423 or 01252 398425 At this time you will be asked a series of questions about the role. HR will advise which level of check the role is eligible for. If it is a standard or enhanced check, HR will book an appointment to apply for a check. Rushmoor Borough Council will charge the member organisation for the check.
The Appointment The person who is being checked MUST attend the appointment and will need to bring: Role Profile Completed privacy notice declaration Original documentation to evidence their identity Completed form (assistance will be provided at appointment if required)
Identity Documents Applicants must provide 3 documents (at least 1 must be from Group 1) Group 1 Valid passport UK Biometric Residence Permit Current UK, Isle of Man, Channel Islands or EEA photocard driving licence (full or provisional) UK, Isle of Man, Channel Islands or EEA Birth Certificate (issued within 12 months of birth) NB: This includes those issued by UK authorities overseas e.g. embassies, High Commissions & HM Forces UK or Channel Islands Adoption Certificate
Group 2 Current Non EEA photocard driving licence (full or provisional) Current UK, Isle of Man, Channel Islands or EEA paper driving licence (issued before 1998) UK, Isle of Man or Channel Islands Birth Certificate (issued after time of birth) UK or Channel Islands Marriage or Civil Partnership Certificate UK HM Forces ID Card UK, Channel Islands or Isle of Man Firearms licence UK or EEA Mortgage Statement** UK, Channel Islands or EEA Bank or Building Society Statement* UK Bank or Building Society account opening confirmation letter* UK or EEA Credit Card Statement* UK Financial Statement e.g. pension or endowment** UK or Channel Islands P45 or P60** UK or Channel Islands Council Tax Statement** UK Utility Bill (not mobile phone)* UK Benefit Statement e.g. Child Benefit, State pension* UK or Channel Islands Central or Local Government, Government Agency or Local Council Document giving entitlement e.g. DWP, HMRC, Employment Service* Valid EEA National ID Card Valid UK, Isle of Man or Channel Islands PASS accredited ID Card For applicants residing outside the UK at the time of application ONLY Valid Non- UK or Non-EEA Letter of Sponsorship from Employment Provider For 16-19 year olds in full time education if other documents can t be provided ONLY Valid letter from Headteacher or College Principal * Dated within 3 months ** Dated within 12 months
What must the documents show? Of these documents, at least one must confirm: Applicant s Full Name Applicant s Current Address Applicant s Date of Birth Applicant s Identity (must have a photo & be a true likeness of them)
Other Documentation In addition to this, you should ask for documentation to prove: Any change of name declared Any previous address (in last 5 years) If an applicant cannot provide documentary evidence of this, you should have a probing discussion with them and cross-match against other information provided by them, and only confirm their identity once happy.
What if the role is eligible only for a Basic Check Anyone can apply for a Basic Criminal Record Check themselves. This will show only current unspent convictions. All roles will be eligible for this if not for a higher level of check, however Rushmoor Borough Council cannot do this check for you.
If the role that you are looking for comes up as eligible only for a basic check, you need to decide whether you want a check. If you do, then the individual will need to apply online via www.gov.uk. There will be a charge for the check.
