Efforts are underway to implement sections of the 2018 Agriculture Improvement Act related to the National Accuracy Clearinghouse (NAC) to prevent duplicate issuance of SNAP benefits across states. The NAC rule requires states to report recipient information, screen applicants against the NAC, and take action if duplicate benefits are identified. Strict privacy and disclosure requirements must be met, and matched individuals must be notified and given a chance to dispute information.

  2. 2018 Farm Bill Requirements Agriculture Improvement Act of 2018 FNS Must Implement two Sections related to NAC Section 4011: Amended Food and Nutrition Action Section 11(x) Establish an interstate data system called the National Accuracy Clearinghouse Promulgate regulations to carry out the requirements of this section Section 4009: Amended Food and Nutrition Action Section 11(e) Take action on matches from the Prisoner Verification System, or Death Matching System as already in regulations and add NAC matches The purpose of the requirement is to prevent multiple issuances of SNAP benefits to an individual by more than one State agency simultaneously 1

Implementation Requirements NAC Rule To prevent interstate multiple issuances, the rule requires States to: Report identifying information for each active SNAP recipient to the NAC Screen all SNAP applicants against the NAC to ensure they are not already receiving benefits in another State Take appropriate action when the NAC indicates that an individual is receiving SNAP benefits from more than one State agency simultaneously 3

  5. Implementation Requirements NAC Rule To meet the strict privacy and disclosure requirements described in the Farm Bill: Information made available by this data match may only be used for the purpose of meeting the requirements to prevent interstate duplicate participation in SNAP 4

Implementation Requirements NAC Rule To meet additional statutory requirements for protecting matched individuals: No adverse action may be taken based on a NAC match without the individual being notified of the match and having an opportunity to dispute the information. The information must be used in a manner that protects the identity and location of a vulnerable individual 5

  7. Implementation Requirements NAC System Establish an interstate data system, to be known as the National Accuracy Clearinghouse Require States to provide information Provide data protections and meet security standards Incorporate best practices and lessons learned from the pilot program Timing: Initial match and corresponding actions shall occur within 3 years after December 20, 2018.
