PART 1: PURPOSE OF CHARTERS
Why Charters?
Article loopout feedback of the Faculty Agreement included
concerns about lack of transparency as to how decisions are
made in departments/ divisions, such as scheduling, selecting
leadership roles, and compensating faculty for leadership
roles/duties.
Charters support a best practices approach to managing a
department/division and promote efficiency, transparency, and
future planning.
With all of the variability between departments/divisions within
and across the ten colleges, FACT did not believe that requiring
a single, one-size-fits-all standard would serve the Colleges and
District most effectively.
Focus on Transparency
Charters require departments/divisions to openly disclose how
they will choose to operate as it pertains to key decisions.
The Charter template does not dictate how departments/
divisions choose to make these key decisions, and these
approaches may continue to vary greatly between areas.
You decide how you want to organize locally, but everyone
needs to know the rules of the game.
Adjunct Faculty Inclusion
The Faculty Agreement replaces the Adjunct Faculty Handbook
and the Residential Faculty Policies by creating one new
document.
The Charter template expects departments/divisions to be
inclusive of adjunct faculty in their practices and to provide
opportunities for information sharing and engagement.
The Charter template establishes some minimum
requirements, and departments/divisions can choose to adopt
even more inclusive practices.

Charter Components & Examples
There are 11 components of the Charter template, 5 required
and 6 recommended.
Sample language has been provided as examples.
You can use or disregard the sample language--as long as you
have the required components, you can include the content
that best reflects how your department/division functions.

:
Any faculty member may propose an amendment to the charter at any time. A written motion
must be submitted to members of the faculty, describing the nature of the amendment and
documenting its need. Faculty members will be given sufficient time to read and consider the
proposed amendment prior to it being discussed in a Division meeting. The motion will be
discussed in a division meeting, and if at least 2/3 of the eligible voting members vote for the
amendment, it will be enacted, subject to the approval of the College Faculty Senate for
compliance with the Faculty Agreement and College Plan. At the request of any voting member,
the vote will be held by secret ballot, ensuring anonymity. 
Voting members who are unable to vote in person due to travel, sickness, or other leave, will
have the opportunity to vote in abstentia.

Every third year from the year of approval, the Chair will appoint an ad hoc committee to
review the charter in its entirety in relation to the Faculty Agreement and the College Plan as
a means of comprehensive review to supplement the on-going amendment process. The
Chair may revise a specific section of the document to comply with District and College
policies at any time. Such a revision will be treated as an amendment. It must be reviewed
and approved by the Division’s voting members.

If an amendment is referred to the ad hoc Charter committee, the Chair will appoint the
committee members. The advocate of the amendment may not serve on the committee. The
committee will review the amendment for its alignment with the Division mission and needs,
with the Faculty Agreement, and with the College Plan. The committee will provide a report to
the Chair to include: 
(1) A copy of the original proposal; 
(2) Written comments about the possible ramifications of the proposal; and 
(3) A recommendation on the acceptance or rejection of the amendment to the faculty
specifying the rationale for the recommendation.

The Chair will fulfill all non-delegable and delegable duties and will receive 100% of the
compensation allocated to the department for faculty leadership.
OR
The Chair will fulfill all non-delegable duties and will receive 60% of the compensation
allocated to the department for faculty leadership. Each delegable duty listed above will be
allocated 4% of the total compensation.
OR
 The Chair will fulfill all non-delegable duties and will receive 60% of the compensation
allocated to the department for faculty leadership. Two faculty leads will fulfill the delegable
duties and each will receive half of the remaining 40% of available department leadership
funds.
OR
The Chair will fulfill all non-delegable duties and will receive 60% of the compensation
allocated to the department for faculty leadership. Each delegable duty will be assigned a
percentage of the remaining 40% of compensation based upon the associated workload of the
specific duty.

The Chair may delegate responsibilities and leadership roles in a manner consistent with the
Faculty Agreement and the College Plan. The Chair assigns workload, 
including, but not
limited to, the assignment of teaching responsibilities,
 and distributes responsibilities 
in
consultation with individual Residential and Adjunct faculty members
 each semester in
accordance with the mission and priorities of the College, and the goals of the Division
.
The Chair may revoke delegated duties each semester. The Chair must provide written (in
writing or electronic) notice of the revocation to the faculty in the leadership role at least 4
weeks prior to the duties being revoked.

The Department will hold elections for all faculty leadership assignments at the end of each
spring semester for the following academic year...

Course assignments are made by the Chair or Program Director consistent with the mission,
priorities, and instructional needs of the Division and the College 
in a manner that is efficient
and fair
. 
The Chair/Program Director, in consultation with each individual faculty member,
determines the course load distribution for each faculty member consistent with faculty
teaching loads, expertise, and based on current need.
OR
Course assignments are made through a round robin process by which faculty take turns
selecting courses one at a time until each residential faculty’s base load is met. The order in
which each faculty makes a course selection rotates each semester so that all faculty have
equitable access to teach any course for which they are qualified.

The Chair will call formal Division meetings at various times during the year, depending on the
volume of business to be conducted, but at minimum at least two times a semester. The
schedule for regular meetings will be announced at the beginning of each fall and spring
semester. 
The Chair shall prepare and distribute a tentative agenda prior to the meeting with
sufficient time for Division Residential and Adjunct faculty and staff members to request that
items be included on the meeting agenda.
Adjunct Faculty shall be invited to attend Division meetings with appropriate compensation
upon the approval of the Chair and with budgetary consideration.

The Division is committed to adhering to the Adjunct Faculty rights outlined in the Faculty
Agreement. The Division recognizes that Adjunct Faculty are an integral part of the Division
whose voice is important in the determination of Division goals, textbook selection, and course
scheduling for those courses that Adjunct Faculty teach. The Division is committed to providing
tools and resources to support Adjunct Faculty retention and success in the classroom.

Fluctuations in enrollment can create unanticipated staffing needs. Inasmuch as is possible,
the Chair will notify Adjunct Faculty of reappointment or non-reappointment at least one term in
advance so that Adjunct Faculty are able to anticipate how many sections of a given course
will need to be staffed. It is understood by all Division faculty that enrollment and College
budgetary needs may impact the timeliness of reappointment notification.

Division faculty are expected to meet their professional and institutional commitments at the
College and within the Division. Faculty should familiarize themselves with the Faculty
Agreement, the College Plan, and the Division Charter to ensure compliance with all policies
and procedures. Faculty should be active participants as committee members, student
advocates, or in whatever other capacity they can render the best service in the affairs of the
Division, the College, and the District.

  5. Why Charters? Article loopout feedback of the Faculty Agreement included concerns about lack of transparency as to how decisions are made in departments/ divisions, such as scheduling, selecting leadership roles, and compensating faculty for leadership roles/duties. Charters support a best practices approach to managing a department/division and promote efficiency, transparency, and future planning. With all of the variability between departments/divisions within and across the ten colleges, FACT did not believe that requiring a single, one-size-fits-all standard would serve the Colleges and District most effectively.   6. Focus on Transparency Charters require departments/divisions to openly disclose how they will choose to operate as it pertains to key decisions. The Charter template does not dictate how departments/ divisions choose to make these key decisions, and these approaches may continue to vary greatly between areas. You decide how you want to organize locally, but everyone needs to know the rules of the game.   7. Adjunct Faculty Inclusion The Faculty Agreement replaces the Adjunct Faculty Handbook and the Residential Faculty Policies by creating one new document. The Charter template expects departments/divisions to be inclusive of adjunct faculty in their practices and to provide opportunities for information sharing and engagement. The Charter template establishes some minimum requirements, and departments/divisions can choose to adopt even more inclusive practices.   11. 1. Policy for Approving and Amending the Charter: Recommended Component [Sample Language] 1.1 Approval: Any faculty member may propose an amendment to the charter at any time. A written motion must be submitted to members of the faculty, describing the nature of the amendment and documenting its need. Faculty members will be given sufficient time to read and consider the proposed amendment prior to it being discussed in a Division meeting. The motion will be discussed in a division meeting, and if at least 2/3 of the eligible voting members vote for the amendment, it will be enacted, subject to the approval of the College Faculty Senate for compliance with the Faculty Agreement and College Plan. At the request of any voting member, the vote will be held by secret ballot, ensuring anonymity. Voting members who are unable to vote in person due to travel, sickness, or other leave, will have the opportunity to vote in abstentia.   12. 1. Policy for Approving and Amending the Charter: Recommended Component [Sample Language] 1.2 Voting Members: All Residential faculty members within the Division are considered to be voting members. The Division Chair votes as a regular, voting member of the faculty. Adjunct Faculty within the Division are to be provided with all proposed amendments and given adequate time to read and provide comment on approval or non-approval of the amendment. Adjunct Faculty comments will be collected in a shared document and given to voting members for consideration at least two days prior to the vote being held. 1.3 Updating Charter to Assure Compliance: Every third year from the year of approval, the Chair will appoint an ad hoc committee to review the charter in its entirety in relation to the Faculty Agreement and the College Plan as a means of comprehensive review to supplement the on-going amendment process. The Chair may revise a specific section of the document to comply with District and College policies at any time. Such a revision will be treated as an amendment. It must be reviewed and approved by the Division s voting members.   13. 1. Policy for Approving and Amending the Charter: Recommended Component [Sample Language] 1.4 Charter Committee: If an amendment is referred to the ad hoc Charter committee, the Chair will appoint the committee members. The advocate of the amendment may not serve on the committee. The committee will review the amendment for its alignment with the Division mission and needs, with the Faculty Agreement, and with the College Plan. The committee will provide a report to the Chair to include: (1) A copy of the original proposal; (2) Written comments about the possible ramifications of the proposal; and (3) A recommendation on the acceptance or rejection of the amendment to the faculty specifying the rationale for the recommendation. 1.5 Conflict: In any event in which this Charter is in conflict with the Faculty Agreement and/or College Plan, the Faculty Agreement and College Plan shall take precedence.   14. 2. Chair Duties: Required Component Duties That Cannot Be Delegated 60% 1. Plan, manage, and oversee the Department/Division budget 2. Review and provide final approval for the evaluation of Adjunct Faculty 3. Review and provide final approval for Department/Division reports (e.g., annual reports, staffing requests, program reviews) 4. Facilitate Department/Division meetings 5. Address, manage and work to resolve conflicts 6. Manage and work to resolve formally registered student concerns 7. Identify, select, and evaluate other supervisory and non-supervisory roles in accordance with procedures set forth in the College Plan 8. Communicate College and District objectives, policies, and procedures to Department/Division faculty and staff and to ensure adherence. Chair Duties: Required Component [Sample Language] 1.4 Chair Duties: The Chair will fulfill all non-delegable and delegable duties and will receive 100% of the compensation allocated to the department for faculty leadership. OR The Chair will fulfill all non-delegable duties and will receive 60% of the compensation allocated to the department for faculty leadership. Each delegable duty listed above will be allocated 4% of the total compensation. OR The Chair will fulfill all non-delegable duties and will receive 60% of the compensation allocated to the department for faculty leadership. Two faculty leads will fulfill the delegable duties and each will receive half of the remaining 40% of available department leadership funds. OR The Chair will fulfill all non-delegable duties and will receive 60% of the compensation allocated to the department for faculty leadership. Each delegable duty will be assigned a percentage of the remaining 40% of compensation based upon the associated workload of the specific duty.   17. 3. Process of Identifying and Delegating Department/ Division Leadership Roles: Required Component [Sample Language] 3. Process of Identifying and Delegating Division Leadership Roles: The Chair may delegate responsibilities and leadership roles in a manner consistent with the Faculty Agreement and the College Plan. The Chair assigns workload, including, but not limited to, the assignment of teaching responsibilities, and distributes responsibilities in consultation with individual Residential and Adjunct faculty members each semester in accordance with the mission and priorities of the College, and the goals of the Division. The Chair may revoke delegated duties each semester. The Chair must provide written (in writing or electronic) notice of the revocation to the faculty in the leadership role at least 4 weeks prior to the duties being revoked. OR The Department will hold elections for all faculty leadership assignments at the end of each spring semester for the following academic year... Course Assignments: Course assignments are made by the Chair or Program Director consistent with the mission, priorities, and instructional needs of the Division and the College in a manner that is efficient and fair. The Chair/Program Director, in consultation with each individual faculty member, determines the course load distribution for each faculty member consistent with faculty teaching loads, expertise, and based on current need. OR Course assignments are made through a round robin process by which faculty take turns selecting courses one at a time until each residential faculty s base load is met. The order in which each faculty makes a course selection rotates each semester so that all faculty have equitable access to teach any course for which they are qualified. Lead faculty select the course textbooks after consultation with the Residential and Adjunct faculty teaching the courses. Division Meeting Schedule: The Chair will call formal Division meetings at various times during the year, depending on the volume of business to be conducted, but at minimum at least two times a semester. The schedule for regular meetings will be announced at the beginning of each fall and spring semester. The Chair shall prepare and distribute a tentative agenda prior to the meeting with sufficient time for Division Residential and Adjunct faculty and staff members to request that items be included on the meeting agenda. Adjunct Faculty shall be invited to attend Division meetings with appropriate compensation upon the approval of the Chair and with budgetary consideration.   21. 7.1 Adjunct Support: Recommended Component [Sample Language] 7.1 Adjunct Support: The Division is committed to adhering to the Adjunct Faculty rights outlined in the Faculty Agreement. The Division recognizes that Adjunct Faculty are an integral part of the Division whose voice is important in the determination of Division goals, textbook selection, and course scheduling for those courses that Adjunct Faculty teach. The Division is committed to providing tools and resources to support Adjunct Faculty retention and success in the classroom.   22. 7.2 Process for Reappointment of Department/Division Adjunct Faculty: Required Component [Sample Language] 7.2 Process for Reappointment of Division Adjunct Faculty: Fluctuations in enrollment can create unanticipated staffing needs. Inasmuch as is possible, the Chair will notify Adjunct Faculty of reappointment or non-reappointment at least one term in advance so that Adjunct Faculty are able to anticipate how many sections of a given course will need to be staffed. It is understood by all Division faculty that enrollment and College budgetary needs may impact the timeliness of reappointment notification. Expectations of Division Faculty: Division faculty are expected to meet their professional and institutional commitments at the College and within the Division. Faculty should familiarize themselves with the Faculty Agreement, the College Plan, and the Division Charter to ensure compliance with all policies and procedures. Faculty should be active participants as committee members, student advocates, or in whatever other capacity they can render the best service in the affairs of the Division, the College, and the District. Division Committees: 9.1 Standing Committees: The Division standing committees shall consist of three (3) to five (5) members, except where the workload dictates otherwise. The seats of standing committees will be filled on a volunteer basis in so far as that is possible. For each committee, the confirmed committee membership will put forward a chair to be confirmed by the Division Chair. The confirmed Committee Chair will convene committee meetings, will see that the committee attends to its charge and does so in a timely manner, and will interact in an official capacity with the Division, College, and District on behalf of the committee as needed. 9.2 Ad Hoc Committees: It will be necessary at times to develop ad hoc committees to perform relatively short-term tasks.Ad hoc committees will be created by the Chair, who may not be a voting member of the committee. The Chair or his/her representative may convene the first meeting of the committee and present the committee with its charge. 9.3 Adjunct Faculty Committee Participation: Adjunct Faculty shall be invited to participate in Division committees with appropriate compensation upon the approval of the Chair and with budgetary consideration.
