Recommendation #5 Undertake an aggressive campaign to educate employers, employees, independent contractors, and the general public about misclassification issues
Recommendation #5 Require the Department of Financial Institutions to include informational materials and resources on worker misclassification with new business registrations. Require DWD to design work site posters that employers must display with information on worker classification laws, requirements, and penalties for non-compliance. Expand DWD's worker classification website to an all-state agency website that explains the common elements of all employee classification tests and lists information on who to contact with questions.
Recommendation #5 (contd) Direct agencies to provide more targeted multilingual educational outreach to employers, workers, and allied organizations that serve vulnerable populations. Emphasize in the communications who to contact and the protection of anonymity to help overcome fear of retaliation. Direct OCI to educate insurance professionals on misclassification issues so they can identify potential violations and report them to the appropriate agency. Develop a communication plan that coordinates activities around Labor Day, such as PSAs, conferences, etc. to call attention to the issues of worker misclassification.
Goal By Q2 2022, 90 percent of employers and workers will be familiar with employee misclassification definitions, the costs of misclassification to workers and to the state, and where to seek assistance on misclassification issues.
