History: Assembly Bills (AB) 1219 and 1505 went into effect January 1, 2020 PRIOR TO PASSAGE AFTER PASSAGE Flexibility for Non-Core assignments Flexibility for teachers already employed in Non-Core general education assignments Monitored at the discretion of chartering authority no set schedule All teaching assignments monitored annually Commission professional fitness not required All teachers must satisfy the Commission s professional fitness screening 3
Service and Non-Classroom Based Assignments Education Code 44258.9(b)(2) provides that misassignments can only be accrued for teaching positions in charter schools. Positions include Administrative, Pupil-Personnel, Health, Librarian, and other similar certificated services positions oriented outside of the classroom. This does not apply to English Learner and Special Education assignments; these positions are not exempt and will be monitored. 4
AB 1505 Assignment Flexibility Education Code 44258.10 gives charter schools flexibility in assignments that were previously exempt from credentialing requirements Applies to non-core content assignments only Core curriculum, English language development, and Special Education assignments are not eligible for this flexibility Applicable educators have until July 1, 2025 to be appropriately credentialed for their positions 5
The subject areas of: 1. Reading, Writing, What is a Core assignment? 2. Mathematics, 3. History/Social Science; and 4. Science which serve as the basis for assessing academic achievement in pupils. Education Code, 60605 6
AB 1505 Assignment Flexibility, Cont. In order to be eligible for this flexibility, those educators must have been employed in their position at some point during the 2019-20 school year. These individuals cannot maintain the flexibility if they are: 1. Assigned to teaching a different subject; or 2. Begin teaching the same subject at a different school 7
This assignment flexibility protects the educators from being removed from their positions. It does not exempt the LEA from incurring a Misassignment. What does AB 1505 flexibility mean? 8
When is a credentialed teacher required? There are three things to consider when answering this question: 1. The student receives a grade or credit for the course and/or; 2. The course counts towards the required daily instructional minutes; and 3. If either of the above are true, does a credential exist that covers the assignment s subject or setting? If the answer to the last question is yes , then Education Code 44001 provides that if certification requirements are established, then a certificated educator is required. 9
Volunteers and Docents Volunteers and docents are welcome in classrooms, as long as they are subject to the immediate supervision and direction of certificated personnel pursuant to Education Code 45349 & 35021. As well, their instruction on a subject in a classroom cannot satisfy assignment certification requirements. Misassignments depend solely on the teacher of record being appropriately certificated for the course s content. 10
Available Educator Information All Points Bulletin (APB) identifies credential holders who have had final adverse action taken against their credential. Charter school employers- Contact Division of Professional Practices at DPPinfo@ctc.ca.gov to receive this report. 11
California Statewide Educator Identifier (SEID) 10 digit randomly generated, non-personally identifiable number. Issued by CTC to all certificated staff that have a valid application or hold a valid CTC document. Used for submitting CALPADS assignment data to CDE. SEID Access is limited to authorized individuals at a County Offices of Education, School District or charter school. Failure to report an assignment in CALPADS with the educator s SEID will result in a Vacancy determination (Misassignment) 12
Local Assignment Options Vast majority require a full teaching credential. Require the teacher serving on the LAO to give their consent for the assignment. LAOs can be reported in CALPADs and determined in CalSAAS. What is Assignment Monitoring? Assuring that certificated educators hold the appropriate credentials and authorizations for their assignments Important because: oCredentials represent the preparation the educator received oGuarantees Student Equity oMonitoring Identifies Areas of Shortage oFulfils State and Federal Reporting Requirements 14
Misassignments Employers have a legal obligation to appropriately assign educators The provisions of numerous state and federal laws define the appropriate assignment of educators Violation of these provisions result in misassignments. Misassignments should be corrected within 30 calendar days of discovery 15

Assignment Monitoring in CalSAAS, Cont Some Charters could not get assistance or a CalSAAS user account from district monitoring authorities. In these cases, if the charter is not able to contact their districts, they may contact the County Office of Education to let them know. Some County Admins/Users may want to monitor their districts authorized charters Can do so by adding a user role as a district user, and adjusting their workload accordingly 18
2019-20 Monitoring Results in CalSAAS 2019-20 Charter Determination selected for 3,877 Exceptions Determination was frequently used incorrectly Cannot be selected for core curriculum (English, Math, Science, and Social Science), English learner exceptions, or Special Education Assignments. 19
