  3. ANECDOTAL RESEARCH - HOW MUCH IS ENOUGH? Anecdotal evidence is not sufficient on its own While anecdotal evidence may suffice to prove individual claims of discrimination, rarely, if ever, can such evidence show a systemic pattern of discrimination necessary for the adoption of an affirmative action plan. Mountain West, 2017 WL 2179120 at *3 (9th Cir.), Memorandum, May 16, 2017, at 10, quoting, Coral Const. Co. v. King Cty., 941 F.2d 910, 919 (9th Cir. 1991) BBC s past efforts have been considered adequate Moreover, the statistical evidence from the disparity study is bolstered by anecdotal evidence supporting an inference of discrimination. The substantial statistical disparities alone would give rise to an inference of discrimination, see Croson, 488 U.S. at 509, and certainly Caltrans statistical evidence combined with anecdotal evidence passes constitutional muster.   4. ANECDOTAL RESEARCH - HOW MUCH IS ENOUGH? Verification and potentially contradictory evidence The Court noted that the Fourth and Tenth Circuits have rejected the need to verify anecdotal evidence . The Court said that Caltrans does not claim, and the anecdotal evidence does not need to prove, that every minority-owned business is discriminated against.
