  1. PREA PRISON RAPE ELIMINATION ACT

  2. OBJECTIVES OBJECTIVES This training is intended to provide information on maintaining professional boundaries with offenders/inmates and your duty to report incidents of offenders/inmates sexual abuse

  3. Sexual Misconduct Sexual Misconduct The ADC policy specifically forbids any activity associated with or that promotes acts of sexual conduct, including sexual harassment between offender and ADC Staff. In this definition STAFF includes contracted staff, vendors, interns and VOLUNTEERS of the ADC.

  4. PREA is a Federal mandate established in 2003 PREA is a Federal mandate established in 2003 PREA addresses the prevention, detection and response to sexual abuse and rape in a correctional setting. This includes all federal, state, local prisons, jails, police lock- ups, private facilities and community settings.

  5. ZERO TOLERANCE ZERO TOLERANCE The ADC is committed to a standard of ZERO TOLERANCE of sexual abuse of offenders by staff. The individuals or staff must be aware that unprofessional relationships will not be tolerated, and these relationships are criminal and may be prosecuted

  6. Professional Ethics Professional Ethics An accused shall be guilty of carnal knowledge of an inmate if: Any behavior of a sexual nature directed toward an inmate by staff Inappropriate touching between offenders and staff Any completed, attempted, threatened or requested sexual acts between staff and the inmate Sexual comments and conversations with sexually suggestive innuendos or double meanings Display or transmittal of sexually suggestive posters, objects or messages

  7. REPERCUSSIONS REPERCUSSIONS Depending on the investigation and finding of an alleged incident, the outcome may result in the loss of your job/assignment and the possibility of criminal charges. In addition, persons accused of sexual harassment in civil or criminal proceedings may be held personally liable for damages to the person harassed

RED FLAGS RED FLAGS Following examples that can be RED FLAGS Deviating from agency policy for the benefit of a particular inmate Overlooking infractions of a particular inmate Spending a lot of time with a particular inmate Taking up an inmates cause or grievance Doing favors for an inmate Flirting with an inmate Getting into conflicts with ADC Staff over an Inmate

  9. YOU HAVE A DUTY TO REPORT YOU HAVE A DUTY TO REPORT DO NOT LOOK OVER RED FLAGS Remember, it s a problem for everyone when staff become involved in unduly familiar relationships and/or sexual misconduct

OTHER THINGS TO CONSIDER OTHER THINGS TO CONSIDER Maintain professional boundaries Focus on assignment Do not do favors Do not accept gifts Do not share personal information Be knowledgeable of the ADC policy and procedure, rules and laws regarding sexual misconduct and sexual harassment No touching of any kind

  11. DUTY TO REPORT DUTY TO REPORT You must report an inappropriate behavior immediately. The presence of illegal and unethical behavior compromises the security and safety of the ADC. If you fail to report, you will be held accountable. All efforts will be made to ensure the confidentiality of the reporting staff member.
