MANDATE The NHC is a Schedule 3A public entity, and an agency of the DSAC The mandate of the NHC is contained in Section 4 of the National Heritage Council Act, Act 11 of 1999 as per the objects of the Act as stated below: To develop, promote and protect the national heritage for present and future generations. To coordinate heritage management. To protect, preserve and promote the content and heritage which resides in orature in order to make it accessible and dynamic.

  4. MANDATE To integrate living heritage with functions and activities of the Council and all other heritage authorities and institutions at national, provincial and local levels. To promote and protect indigenous knowledge systems including but not limited to enterprise and industry, social upliftment, institutional framework and liberatory processes: and To intensify support for the promotion of history and culture of all our peoples and particularly to support research and publications on enslavement in South Africa.

  21. APPOINTMENT OF ADMINISTRATOR AT NHC The previous Council of NHC was dissolved on 21 August 2020. Former CEO resigned at the same time the Council was dissolved. This happened after allegations of corruption and money laundering against the CEO and other members of management were brought to the attention of the Minister. The dissolution of Council and the immediate resignation of the CEO posed a risk to the continued operational stability of the entity. Minister in consultation with the Minister of Finance appointed a team of Administrators to take care of the institution until a new Council is appointed.

  22. APPOINTMENT OF ADMINISTRATOR AT NHC New Council was appointed with effect from 1 December 2020 and the Administrators handed over to Council. One of the Administrators (Ms L Mabe) remained and fulfilled the role of the CEO of the NHC in an Acting capacity. Council ratified the acting appointment which was in place until the appointment of the new CEO. Currently the NHC is not under administration as there is an Accounting Authority and the Accounting Officer in place.

  23. FORENSIC INVESTIGATION UPDATE Forensic investigation was conducted on allegations of irregularities in respect of money laundering, misappropriation of funds and other irregularities by the officials of the NHC. The Chief Financial Officer has been on suspension since June 2021 and the disciplinary hearing is due to start in April 2022. The initial charges brought against him at that time were not related to the forensic investigation report (report) and after Council decided to implement the report, the charges had to be revised to include findings from the report. The National Heritage Council (NHC) approached the Office of the State Attorney to assist in this matter and the Prosecutor in this matter is at the final stages of revising the charges.

  24. FORENSIC INVESTIGATION UPDATE The Acting Supply Chain Manager has been on suspension since November 2021 on charges related to the findings in the report. The disciplinary hearing which is also being handled by the state attorney commenced in February 2022 and is still on-going. The employee tried to stop the disciplinary hearing by bringing an urgent court application which was struck off the roll. The NHC is confident that the hearing will be finalised speedily due to overwhelming evidence against the employee which flows from the report. With regards to findings relating to the former CEO of the NHC, a full affidavit with annexures of alleged evidence was submitted to the SAPS in November 2021 with the following Case No. 312/12/2021. SAPS is still investigating the matter further and some of the findings in the report has been sent to the SIU for further probing.
