  2. Vignette 1: Sexual Harassment Ms. Leslie Robinson, a DA Civilian, works in the cube farm environment (which is a workplace containing several cubicles) at the in-processing center. One day, SSG Bill Evans, the section leader, stopped by SPC Mark Fields cubicle, and the conversation turned to a discussion of Ms. Robinson s breasts and butt. SSG Evans remarks to SPC Fields that he would like to take Ms. Robinson back to the barracks and let her teach him a few things. Ms. Robinson did not hear any of it, but two other co-workers, SGT John Weaver, and SPC Tina Michaels, sitting unseen in the adjacent cubicles, heard the comments. SGT Weaver observed that SPC Michaels was uncomfortable with the conversation. Later in the day, SSG Evans and SPC Fields passed SPC Michaels and SGT Weaver in the break room, after which SPC Michaels confides in SGT Weaver that she does not want to work with SSG Evans nor SPC Fields. She says that was not the first sexual innuendo she has heard from SSG Evans, and she doesn t want to work with him if that s how he is going to talk about women. SPC Michaels also mentioned that she was going to tell Ms. Robinson about the remarks when she returned to the office in the morning. The next morning, SPC Michaels tells Ms. Robinson about SSG Evans comments. Ms. Robinson becomes very angry and decides to inform her non-commissioned officer in charge. In addition, if she wants to pursue administrative remedies through the Equal Employment Opportunity process, she will have to contact the EEO office to initiate a complaint within 45 calendar days. The 45 day time limit to contact EEO is not stopped when the chain of command is notified or extended while they are investigating and/or pursuing corrective action. 2

  4. Vignette 2: Obtaining Consent SGT Robert Atkinson calls SGT Mary Brown to pick him up from a bar and take him home. Though heavily intoxicated, SGT Atkinson asks SGT Brown to walk him up to his apartment, where he tells her he wants to have sex with her. Once they enter his apartment, SGT Atkinson begins kissing SGT Brown. SGT Brown kisses him back and asks, Where is your bedroom? SGT Atkinson guides SGT Brown to his bedroom and she begins to undress. While she s undressing, SGT Atkinson lays back and passes out. SGT Brown undresses SGT Atkinson and begins performing oral sex on him, attempting to arouse him even though he is passed out. Has SGT Brown obtained consent from SGT Atkinson in this situation? 4

  5. Vignette 2: Obtaining Consent Questions: Did SGT Atkinson say anything to indicate to SGT Brown that he agreed to the sexual conduct? If so, please indicate what he said. Did SGT Atkinson provide overt physical indications to SGT Brown that he agreed to the sexual conduct? If so, please indicate what he did. Was SGT Atkinson able to resist SGT Brown s sexual conduct? Why or why not? Is SGT Atkinson able to give consent to SGT Brown s sexual conduct? Why or why not? 5

  6. Vignette 3: Obtaining Consent SGT Kenworthy and SPC Clark are off-base and begin making out. SGT Kenworthy begins to undress SPC Clark, who seems to want it. As they kiss, SPC Clark says yes but as SGT Kenworthy goes to remove SPC Clarks pants SPC Clark says no . Has SGT Kenworthy obtained consent from SPC Clark in this situation? 6

  7. Vignette 3: Obtaining Consent Questions: What did SPC Clark say to indicate to SGT Kenworthy that she agreed/disagreed to the sexual conduct? Please indicate what she said, what she agreed to and what she did not agree to. What did SGT Kenworthy do when SPC Clark indicated her consent to kiss? What did SGT Kenworthy do when SPC Clark indicated her non-consent to engage in sexual conduct other than kissing? Did SGT Kenworthy have permission to engage in any other sexual conduct other than kissing? What should SGT Kenworthy have done once SPC Clark indicated that she did not consent to engage in any sexual conduct beyond kissing? 7

Vignette 4: Obtaining Consent Mrs. Clark, Department of the Army Civilian, decided to join the rest of her section for an evening of team building and relaxation at the Installation Bowling Alley Friday after work. Since the group arrived prior to 6pm, they were able to partake in the Happy Hour 2 for 1 drink special. As the group continued to bowl, laugh and drink, Mrs. Clark began to feel a little sick. She sat out the last game in an attempt to settle her stomach. When the games had ended, and everyone was leaving, SFC Mitchell, invited Mrs. Clark to his residence for a night cap. Since he lived on the installation, she figured it wouldn t hurt anything. While at SFC Mitchell s home, the drinks began to flow again, and the conversation moved to the living room couch. SFC Mitchell turned on a movie and just half way through, Mrs. Clark laid down, and passed out. SFC Mitchell carried Mrs. Clark to his room, and while she was passed out, undressed her and had sex with her. During the sexual intercourse, Mrs. Clark was in and out of consciousness and recalls portions of it. When she awoke the next morning, she quickly gathered her clothing, and left SFC Mitchell s home. 8

  9. Vignette 5: Sexual Assault PV2 Jonathan Jackson arrives at his first duty assignment at 0800 hrs. That Friday, SPC Murphy invites PV2 Jackson to play spades later that evening with him and his two roommates, PFC Wilson and PFC Burgess. PFC Burgess retrieves a bottle of Jack Daniels from his wall locker while PFC Wilson grabs Pepsi from the refrigerator. Once the mixed drinks are gone, the group decides that the losing hand has to take a shot of Jack Daniels. PV2 Jackson is so drunk that he s sick and vomiting. The next morning PV2 Jackson wakes up naked in bed. He vaguely remembers SPC Murphy helping him out of his clothes and into bed. He also remembers waking up a couple times because of SPC Murphy touching him. He s not sure if it was just SPC Murphy messing with the new guy, or if it was something else. PV2 Jackson feels humiliated and taken advantage of. 9

  10. Vignette 6: Retaliation SPC Smith reports to the SARC/VA that Soldiers are discussing rumors about her case and are posting favorable comments for the platoon sergeant on Facebook. She feels she is being retaliated against because she reported a sexual assault. What are SPC Smith s avenues of redress? What action do you take if SPC Smith declines reporting the alleged retaliation? What advice do you provide to the command team? What does the command team/IG owe you? What is the best course of action to address the alleged retaliation? Facebook: SPC Smith reports that her platoon sergeant sexually assaulted her. The other Soldiers in her company do not believe that the platoon sergeant would ever do something like this. The Soldiers begin to discuss rumors they have heard about the facts of the case that SPC Smith was drunk at the unit party and performed oral sex on another Soldier in full view of everyone there. SPC Smith s roommate tells other Soldiers that SPC Smith has a different man in her bed every weekend and enjoys rough sex. Soldiers post comments on the unit Facebook page expressing their support for the platoon sergeant. Best Course of Action: SARC/VA should refer SPC Smith to the chain of command and a Special Victim Counsel (SVC) for assistance. This type of alleged retaliation could be ostracism or maltreatment and should be investigated by the victim s chain of command. Consult with servicing legal office. Additional Courses of Action: SARC/VA could refer the victim to the local IG, if the chain of command doesn t respond adequately.. 10

Vignette 7: Retaliation SPC Smith reports to the SARC/VA that her team leader is threatening to withdraw her promotion packet if she continues with the court-martial process against her platoon sergeant. She feels she is being retaliated against because she reported a sexual assault. What are SPC Smith s avenues of redress? What action do you take if SPC Smith declines reporting the alleged retaliation? What advice do you provide to the command team? What does the command team/IG owe you? What is the best course of action to address the alleged retaliation? Promotion Board: SPC Smith reports that her platoon sergeant sexually assaulted her. As the date for the court-martial approaches, the team leader tells SPC Smith that if she continues on this path he will be forced to withdraw her promotion packet from the board because she won t really have time to prepare properly Best Course of Action: SARC/VA should refer SPC Smith to the local IG and a Special Victim Counsel (SVC). This type of alleged retaliation could be a threat to withhold a favorable personnel action and should be investigated by the IG. Additional Courses of Action: If the victim declines to report the alleged retaliation, the SARC/VA should report the allegation to the victim s chain of command. Consultation with servicing legal office is highly recommended. 11

  12. Vignette 8: Retaliation SPC Smith reports to the SARC/VA that her team chief has removed her from her daily duties and assigned her to multiple details. SPC Smith tells the SARC/VA that she likes her job and has always been told she was doing well. What are SPC Smith s avenues of redress? What action do you take if SPC Smith declines reporting the alleged retaliation? What advice do you provide to the command team? What does the command team/IG owe you? What is the best course of action to address the alleged retaliation? Change in Duties: SPC Smith reports that her platoon sergeant sexually assaulted her. The team chief pulls SPC Smith from her daily duties and assigns her to multiple details. SPC Smith complains to the team leader that she likes her job and has always been told she was doing well. The team leader explains that as she recovers from her trauma and because she has so many appointments with her lawyers and behavioral health, he wants to take some of the pressure off of her. Best Course of Action: SARC/VA should refer SPC Smith to the local IG and a Special Victim Counsel (SVC). This type of alleged retaliation could be a significant change in duties or responsibilities inconsistent with the victim s grade and should be investigated by the IG. Additional Courses of Action: If the victim declines to report the alleged retaliation, the SARC/VA should report the allegation to the victim s chain of command. Consultation with servicing legal office is highly recommended. 12

  13. Vignette 9: Retaliation SPC Smith reports to the SARC/VA that her once tight-knit group of friends are avoiding her and excluding her from social events. She feels she is being retaliated against because she reported a sexual assault. What are SPC Smith s avenues of redress? What action do you take if SPC Smith declines reporting the alleged retaliation? What advice do you provide to the command team? What does the command team/IG owe you? What is the best course of action to address the alleged retaliation? Social Acceptance: SPC Smith reports that her platoon sergeant sexually assaulted her. Prior to the report, SPC Smith had a tight- knit group of friends in the unit who socialized together all weekend. After the report, SPC Smith becomes moody and depressed. Her friends find her difficult to be with and begin avoiding her on and off duty and exclude her from social events. SPC Smith is devastated by the loss of her friends and feels isolated and unhappy. SPC Smith tells her team leader that she wishes she had never made the report. Best Course of Action: SARC/VA should refer SPC Smith to the chain of command and a Special Victim Counsel (SVC). This type of alleged retaliation could be ostracismand should be investigated by the victim s chain of command. Consult with servicing legal office. Additional Courses of Action: SARC/VA could refer the victim to the local IG for assistance. 13

  14. Vignette 10: Bystander Intervention One Friday night, there was a party at PFC Alton and Jones apartment. It was their tradition to host poker parties into the early morning hours. Both men and women from the unit were invited. PFC Jackson attended and he was known to like to party because he always came to the party with a bottle of tequila, salt, and lime. He decided to join a poker game and invited PFC Simms to join him at the poker table. When she won the first hand, Jackson suggested that she do a shot of tequila. After 30 minutes, he had encouraged Simms to drink four more shots of tequila, as well as drink a beer. She started to slur her word and it was obvious to people playing poker that she was intoxicated. Jackson moved closer to Simms, put his arm around her and suggested that they go outside to get some fresh air. She declined, but Jackson kept suggesting that they go outside. Simms got up and said that she needed to use the bathroom. As she left the poker table, Jackson told the players that it was time to make his move and he followed Simms down the hallway to the bathroom. Several of the people playing poker looked at each other and wondered what, if anything they should do. As Simms entered the bathroom, Jackson put his foot down so she could not close the door. He entered the bathroom with Simms and locked the door behind them. Once inside the bathroom, Jackson started to kiss Simms; she backed away from him, but could not get away from him. He continued to try to kiss her and ripped open her button-down shirt. Simms banged on the door and several people outside the door noticed the loud bangs. 14
