State Responsible Inmates with Marijuana Convictions Research Report

Research conducted by VADOC indicates a total of 570 state responsible inmates incarcerated for marijuana-related offenses as of August 31, 2021. Among them, 229 inmates had non-drug-related Most Serious Offenses, 331 were convicted for Drug Sales MSO, and 10 were convicted for Drug Possession MSO. Further analysis reveals that 341 inmates with marijuana-related Drug Sales or Drug Possession convictions had non-marijuana-related MSOs, with 10 convicted for transporting marijuana into the Commonwealth. The report also highlights inmates with mandatory minimum sentences for offenses like selling marijuana to minors, providing insights on expected release dates and associated MSOs.

SR Inmates with Marijuana Convictions 2 As of August 31, 2021, there were 570 state responsible (SR) inmates incarcerated for 599 marijuana- related offenses (1.8% of Total SR Population) 229 inmates with a non-drug related Most Serious Offense (MSO) 331 inmates with a Drug Sales MSO 10 inmates with a Drug Possession MSO* VADOC Research Unit January 7, 2022 *Includes possession with intent to distribute (PWID)

NAR-3114-F9 Marijuana Mixture Distribution, 100kg or more Mandatory Minimum = 20 Years 7 As of August 31, 2021: 1 SR inmate was serving time for 1+ convictions for NAR-3114-F9 The expected release date* for this inmate is after FY2027 The MSO for this inmate is Drug Sales NAR-3126-F9 Marijuana, Sell <1oz, Minor Assists in Distribution Mandatory Minimum = 2 Years As of August 31, 2021: 1 SR inmate was serving time for 1+ convictions for NAR-3126-F9 The expected release date* for this inmate is in FY2026 *Does not take into account the new good time earning rates that go into effect on July 1, 2022 which may move up their release dates; depends on whether or not sentences for these offenses are being served consecutively and/or concurrently with sentences for other offenses The MSO for this inmate is Rape/Sexual Assault VADOC Research Unit January 7, 2022
