  4. Chapter 27: Environment and Climate Change The provisions of the Directive is at very early stage of transposition. Parts that are harmonized with the Directive refer on the Article 56 in the Law on Forests ( Off. Gazette of MNE no. 74/10) according to which: with wood products can be traded only on the basis of certificates of origin issued by the user of the forests owned by the state or the owner of the privately owned forests. Chapter 27: Environment and Climate Change Implementation Competent authority A competent authority for the FLEGT Regulation has not been designated as required by Article 7, paragraph 1 of the Regulation The new Law on Forests partly includes the basic objectives and mechanisms of this Regulation, which entered into force in December 2010. In fact, come into force only some provisions of Regulation. Forest Administration gives the forests for use by concession and the concessionaire performs control and issued certificate for origin of wood products.   7. Chapter 27: Environment and Climate Change National Action Plan (NAP) The Government of Montenegro adopted National Action Plan (NAP) to combat illegal activities in the forestry. So far, only obligations arising from the Directive which are also related to implementation of the NAP are implemented, for example: - The term "illegal activities in forest exploitation" (illegal logging), we used the official definition of the World Bank (WB) - Under monitoring of NAP for combating illegal activities in the forestry, it s included the timely introduction of the Coordination team with the facts, data and information across team members, analyzing and proposing adequate measures. The goal of the NAP is to combat illegal activities in the forestry, including forest harvesting, capturing forest land illegally, the deliberate planting of forest fires, the prevention of proving the destruction of boundary lines between state and private forest, the corruption in the forestry sector, with special emphasis on illegal activities in forest exploitation and trade in illegally harvested timber. Chapter 27: Environment and Climate Change Implementation Competent authority Law on Forest and regulations are in line with the concerns of penalties: - Pursuant to the Article 89, item 11 of the Law on forests any person who distributes wood products without issued certificates of origin shall be punished for a misdemeanor.
