Terminal Learning Objective Action: Understand the implementation requirements and administrative procedures required for a Bar to Continued Service Condition: Given a classroom environment with a group of senior leaders, Army Directive 2016-19, AR 601-280 Chapter 8 and a DA Form 4126 Standard: To ensure senior leaders understand the implementation guidelines and processing procedures for a Bar to Continued Service

  3. Safety Considerations FIRE: Exit the building and form up in the parking lot for accountability. TORNADO: Exit the classroom and go into the hall, sit down and wait for the all clear. ACTIVE SHOOTER: We will lock the classroom door, get against the front walls, remain quiet and wait for the all clear. 3

Guidelines May be initiated Will not be initiated -Soldier refuses to reenlist -Separation action is pending -In place of trial by court martial, non-judicial punishment, other administrative action -Soldier is serving in the NCO Career Status Program -As a punitive action -Approved retirement

  12. Initiating a Bar to Continued Service Any commander in the Soldier s chain of command can initiate Normally company, battery, troop, or detachment commander

  13. Initiation Steps Gather supporting documents Determine appropriateness Determine approval authority Complete DA Form 4126 and forward to next level commander Update IMREPR/AEA

  14. Gather Supporting Documents Counselings (DA Form 4856) UCMJ paperwork Most recent SRB

  15. Determine Appropriateness No generalities, approximate dates, or vague places and times Specific incidents substantiated by official remarks Factual and relevant Counseling for each occurrence Considerations if assigned less than 90 days Initiation regardless of ETS, departure date, or reenlistment intent Recent events

  16. Approval Authority Less than 10 years of TAFS at initiation First commander in the rank of LTC or above/SPCMA. More than 10 years of TAFS at initiationFirst brigade-level commander, COL or higher/GCMCA. Approval authority must be at least one level higher in the chain of command than the initiating commander Any level commander can disapprove

Appealing a Bar to Continued Service 7 days from notification of Bar approval Appeal approval authority must be at least one level higher than the original Bar approval authority -Less than 10 years TAFS at initiation -First COL (brigade commander) or first GO/GCMCA -More than 10 years TAFS at initiation First General Officer Final disposition within 30 days of submission using formal counseling

  22. Update IMREPR/AEA IMREPR = 9K AEA Code = C (6 month termination date)

  23. Reviewing a Bar to Continued Service Every 3 months after date of approval and 30 days before departure If removal is recommended, forward to the approving authority If recommended to stay in place, formal counseling must be completed Formal counseling will be completed for each review

  24. Removing a Bar to Continued Service Submit recommendation in writing to next higher command Each commander will review and personally endorse the recommendation for removal Flagging actions associated with the Bar will be removed Update IMREPR/AEA

  25. Separation If at the 2nd, 3 month review, the Soldier has not overcome the reason for the Bar, the commander must initiate separation proceedings Separation action is not required when: -More than 18 but less than 20 years TAFS -ETS does not allow processing time -Eligible for retirement with more than 20 years TAFS
