  4. DEBT MANAGEMENT Debt management is part of the SARS enforcement division that deals primarily with following up on outstanding and overdue debt in terms of all taxes. We are also responsible for Account Maintenance functions as SARS has an obligation to collect only the correct amounts that are due and payable. 4

TYPES OF TAXES THAT WE COLLECT PIT-Personal Income Tax for individuals(including Provisional Tax) CIT-Company Income Tax for entities(including Provisional Tax) Admin Penalties for non submission of Personal Income Tax Returns VAT-Value Added Tax for individuals and entities PAYE-Pay As You Earn for Salaried individuals through their employers Dividends Tax also known as STC-Standard Tax on Companies for Dividends that companies issue or pay out. Donations Tax-for any donations made Customs & Excise Duties for Imports and Exports SARS also collects SDL-Skills Development Levy and UIF- Unemployment Insurance Fund on behalf of the Department of Labour 5

DEBT MANAGEMENT PROCESS FLOW We make phone calls to Debtors Issue Final Demand s Issue Third Party Appointments(Stop Orders/Debit Orders) We do Writs of Executio n Issue Civil Judgements by Default Taxpayer makes full payment case finalised Taxpayer requests payment arrangements and signs an agreement/terms Case finalised/completed due to Payment received or outstanding taxes recovered Taxpayer disputes the debt/Payment is suspended wholly or partly 6

REMEDIES AND RECOURSE Providing SARS with the correct contact details Provisional Tax payments(end of February and August mostly for individuals and different financial year end mostly for companies) Apply for payment arrangements where its impossible to make full payment for affordability purposes (either by email, on efiling or through the SARS Contact Centre) Apply for Compromise/Settlement of Debt when facing legitimate financial constraints Apply for waiver of Penalties where sufficient grounds exist for late payment or submission of tax returns 7

  9. CONCLUSION SARS is a state organ that has been mandated to collect revenue on behalf of the state and ensure that every citizen pays only what is due to the state. SARS always functions within the parameters of the Income Tax and Tax Administration Act and our actions and decisions are guided solely by these Legislative requirements. 9
